    Unlike the bullshit the right wing imagines are violations of the constitution here is an actual case of a state violating the constitution.

    Texas is refusing to provide birth certificates to hispanic women who cannot prove they are citizens. The problem is the constitution is absolutely clear; anyone born in the US is automatically a US citizen.

    Not that I don't think this law, or what ever it is, is bullshit, but it's not saying the kids aren't citizens...just that their mothers can't have access to their birth certificates without proof that they are citizens.

    That law also won't survive judicial review. California's proposition 187 tried to deny all public services to illegal aliens and the court threw it out as unconstitutional.

    There's no functional difference between the state denying a child's citizenship and the state denying any legal method for that child's citizenship to be proven. A right without a remedy is no right at all.

    The birth certificate belongs to the child, a US citizen, and property of a US citizen should never be handed over to an illegal alien, especially identity documents that could be used for fraud and theft.

    I didn't say I would get rid of this part:

    What I said was we need to repeal and replace the 14th amendment. If I were to replace it, I would write a new amendment with that language in it. To answer your other question, states can't just grant citizenship to people just for asking, there would be specific standards and once you are granted citizenship, you would be a citizen of the whole country, not just one state.
