The judicial system has been confirming that for the longest time. Anyone ever see that episode of All in the Family where Gloria gets attacked on her way home? That episode aired nearly 45 years ago and we're still having the same conversations of victim shaming cuz she was told not to go by the construction site because they were always catcalling at her and how dare she not listen to her husband? Even as an eleven year old watching that episode, I wanted to shake Mike for siding with Archie on not pressing charges.

It's important not to send men to prison just for assaulting or raping women because they might make other contributions to society. Just ask Hillary, married to a serial rapist.
So they got drunk, got naked, got in bed together, all three, and then one pair had sex. He stopped when she objected. Yeah, that is bad but does deserve extra consideration in my mind as getting naked and getting in bed with someone does imply some sort of consent. Feeling regrets or shame the next day does not change that. Anna should remember how many black men were wrongly imprisoned because they had consensual sex with white women only to find the next morning she had second thoughts and screamed rape rather than admit she agreed to fuck a black man. Yes, alcohol was involved with all parties and that should be considered (as does the epidemic of underage drinking in America) but the punishment seems to fit the actual facts of the situation. For all of the shot all in the family got for being real to real life situations they did take on social problems no other contemperary show would touch. They also resulted in The Jeffersons as a spin off so I like that.

It doesn't, but let's not forget that a guy who was caught in the act by two complete strangers and several eye witnesses who saw the victim push him away earlier only served 3 months. The number of women making shit up is inconsequential compared to the ones that did it and get off with charges dropped or some slap on the wrist sentencing. That includes a good number of minorities. Speaking of: The number of wrongly accused black men in prison is higher than most because there are more black men in prison. That doesn't negate the fact that the majority of accusers aren't liars. Ok.
I never said everything was fine. I did say the punishment fit the facts of the case because it does.
Oh, and I am not sure about the percentages of people broken down by race who are wrongfully imprisoned but I do agree blacks are more commonly convicted. Part of that is resources (you will notice OJ got away with a double murder because he had money) and part of that is simply poor people commit more crimes (either put of necessity or due to culture). Well off folks don't generally commit armed robbery both because they do not need to but also because that is not a culturally acceptable thing to do.
The one thing I noticed about these cases is that most of 'em get off cuz they're first time offenders. I mean really now? Do we let off first time murderers to go to college and hope they don't kill again?
Funny thing (to me) about the "first time offender" rule: when my son got arrested and was awaiting trial, I asked his lawyer about invoking the first offender rule, since the charges were escalating which is not a good sign. The lawyer said it would never happen because the judges in our county won't let first offenders waste their "one free shot" on something trivial, making them wait until they committed major felonies. Wrap your head around that - you can't use your "first offender" rights until you have committed a smaller crime first - at which point your major crime would not be your "first" offense, but it would be the first time you used your right so it's like it was your first time, so close enough! Because if you use your first offender loophole on your first offense and get nailed later, you could fuck yourself. Damn I wish I were smart - I would have definitely been a lawyer!
Why would two dudes be going to bed naked together, even if they were drunk? If what Dinner described is true, there is some reasonable doubt over how "consent" applies. Context matters. That being said, it seems there was enough evidence to convict, and the judge fracked up with the sentencing. So what's the solution, mandatory minimum sentencing? Just as the justice system distinguishes between different types of killing (ie, murder 1, murder 2, manslaughter) it might be useful to establish different "degrees" of sexual assault. There is a clear moral and practical difference between attacking a strange women on the street and sticking your dick in someone when you're drunk and she's already naked in your bed.
Point of order: most assaults happen between people who know each other to some degree. Those whole "getting jumped on the street and dragged to a rape van" scenario is incredibly rare.

And yet the latter is the classic definition of rape. So part of the problem in addressing these issues is that courts expect prosecutors to prove that level of premeditation and aggression, which doesn't fit. New categories of offenses are needed.
