He jumps out of a bush at 11:30 pm. (Questionable judgment, especially in Florida.) Father-in-law freaks out and shoots him. Son-in-law is now deceased and law enforcement will not press charges. Sounds to me like the father is living the dream of every dad with a daughter! America, fuck yeah!!!1!
It seems to me tht you charge the man with a felony because he is irresponsible with a gun and needs to be punished and not have a gun anymore. You charge the fool. Let him present his defense in court. Let a jury decide his fate as it should be. This is why they call it floriduh.
I agree! Charge him and have a trial. Easier said than done though - will the DA even think it's worth the trouble? UPDATE! I went back and read the story - so now let's consider: 1) a fenced yard. If you climb a fence (assuming that's how he got into the yard) into somebody's back yard you're not accidentally knocking on the wrong door for example. 2) the shooter just had a heated confrontation with somebody who was recently pounding on his front door. Now an hour later somebody is pounding on his back door without identifying himself? The shooter had every right to be armed when he opened the door. 3) somebody is suddenly jumping out of the fucking bushes? Not a lot of time to second-guess their motives there! Nobody jumping out of the bushes to ask you if "you've heard the good news". so damn....this was some seriously bad timing for the son-in-law. Had he known the shooter recently had a heated confrontation I'm 100 percent certain he wouldn't have sprung this surprise. No wonder he DA wouldn't consider this case when you consider all the facts in context. No malice, no drunken irresponsibility, not even bad judgement from shooter nor victim.
Agree with Dayton - many fathers-in-law aren't fond of their sons-in-laws (nobody good enough for their baby girl) but wanting to kill them? Not very common I would think. I have no beef with my son-in-law. So far he's handled every family situation with my daughter very well. She's not easy to live with on a day-to-day basis. And my grand daughters are adorable so there is that!
If my daughters get married and their husbands ever physically abuse them, I’d definitely fuck those guys up.
I still think it should go to trial. No cop should be deciding a case of murder on their own. We pay the DA to do these things. This is a killing not a traffic infraction. Present the facts to a jury or a judge because that is what should be done. If a jury or judge wants to decide it is a case of the castle doctrine then that is that. When we leave these questions to a police officer or DA to decide they have too much power and their bias becomes a part of it. If they want to skip over their job then do it on smaller crimes, not ones involving a person's death.
We have, in this country, a very well-funded movement devoted to convincing people -- especially men, which is statistically somewhat ironic -- that their gun is the only thing standing between them and the constant danger of being attacked at any given moment by a random stranger. Think that mindset, and the industry that profits by encouraging it, might have anything to do with this case?
I tell something similar to people at the after hours that ask about my security. "I have a sawz-all, garbage bags, and work during the week for a Russian owned construction company..."
When I visited the Eiffel Tower with my nephew in 1999, he said he was going to sneak back in the middle of the night and dismantle it with his Sawz-all.
If there's someone you really don't like or has really pissed you off, take a Sawzall, and make a horizontal cut around their house at chest height. The Sawzall would rip through that pretty easy. And pretty much fuck up their house. Actually, don't do that.
Maybe Americans (men and women) should learn how to fight better hand to hand. Seriously. It has been suggested by people who study the subject that one reason American law enforcement officers (LEOs) are quick to use their firearms is that they lack training in unarmed combat. A guy who used to be one of my best friends before he changed jobs from history teaching to law enforcement said quite recently that their training (state police) in hand to hand close combat was "minimal".
The problem with hard handed defense is that the officer can't determine the capability of the suspect until they are engaged in hard handed tactics. Using less than lethal or lethal tactics places the officer at and advantage. If the officer is incapacitated then the suspect can possibly have access to a firearm they didn't have before.
What if officers are given preemptive authority to use lethal hand to hand tactics? While not the best option surely that is less likely to kill than using a firearm.

yes, that's a winning strategy! Encourage cops to beat people to death. And "lethal hand to hand tactics?" I think you've seen too many Bruce Lee movies. The human body is incredibly tough, and people tend to fight back or get the fuck out of range when somebody is fighting them. I'm going to assume that you don't have much actual fighting experience or training, but it would take an INCREDIBLE amount of time and effort to teach cops to be really good at hand-to-hand combat. And all the training in the world won't help you overcome the laws of physics! If somebody is bigger, stronger, faster or has a bigger gas tank.....you are fucked like chuck. Just to use an example all those self defense tactics for women and old people work great in theory, but reality says otherwise. Basically any self defense/martial art that doesn't entail you dealing with getting your ass beat as part of the training is worthless.
