Basically, in Santa Barbara County, if the cops think there are minors drinking inside a place they can just go ahead and enter the residence.

So not only is it not about citing the actual minors (under a really hypocritical existing law), it's aimed at this idea of punishing whoever the homeowner happens to be, but the cops can still just barge on in to check IDs the way it looks. Which gets even more ridiculous if these are all just roommates and not all of them are 21 or over. And they don't even have a real plan in place with how to deal with enforcement, but they're going to go ahead and start enforcing it anyway. Makes sense. :garamet:

And there's your answer. Can't they just call this fucking thing a mandatory fundraiser so that there's at least a faint tinge of honesty around the edges?

Haven't you guys all heard? Nobody in the government except those nine robots on the Supreme Court bother to pick the Constitution apart anymore. And figuratively, that's what they do, they PICK it APART. "We like that, we're gonna ignore this, we're gonna say this says that, or just fuck the damned thing and cite some foreign law as the reason for our verdict." The politicians and law enforcement just ignore it altogether. The only thing they CAN'T ignore is the second amendment, because that's the "only one" that would send Americans marching in on Congress with guns blazing if they ever tried to slash it.

They've cited foreign law for their precedents? Each and every one of them who's done that should be dragged out in front of cameras in front of all the news channels, have it announced to the public, and then caned, Thailand-style, until they urinate and/or defecate on themselves.

    And then executed.

Thanks to the War on Drugs, the 4th Amendment has been virtually gutted. Good job LBJ and Nixon.

Ah, reminds me of my greatest cop story. Got pulled over on the Northern Kentucky University campus. Was driving a Ford Aerostar (that's a van), with the two back seats taken out. Two minors in the back, sitting on the floor, holding two gallons of wine, a fifth of Jack Daniels, and a twenty-four pack of beer. Cop asked if he could search the car, and being an idiot, I agreed. Found the minors, found the booze, found several open (though empty) cans of beer. Told him I was dropping them off at their dorms before heading to my apartment to start a party. Luckily, we were all stone sober. Let me off with a warning.

Anyone entering my residence without the permission of a residence or an announced warrant is going to be treated like what they are - an unidentified threat.

This crap might fly in the metro areas of pussified California. Here and in the real America police wouldn't dare do this!

You can't let a little thing like liberty or unreasonable search and seizure get in the way of thinking of the children.

You're in L.A., right? Get on the 210 and head East 2-3 hours (depending on traffic). :)

210 morphs into the 134, and the 134 into the 101, so you're actually wrong, Bick. He'd end up around Santa Barbara or San Luis Obispo, depending again on traffic.

Uh, no. That transition's in Pasadena, not LA. The 210's western end is at I-5 at the north end of the San Fernando Valley.

There's a junction. The 210 turns into the 134 simultaneous with the I-5 running north-south. Pasadena is adjacent to valley, if you're heading west from LA on the 210 you're leaving by way of Pasadena.

:garamet: I'm not convinced you know your Los Angeles geography very well.

The I-210/CA 134/CA 710 interchange is in downtown Pasadena, which is northeast of downtown Los Angeles, as noted by the route that CA 110, the Pasadena Freeway (or Arroyo Seco Parkway) follows. From Pasadena, I-210 going west goes NORTH from downtown Pasadena to La Cañada-Flintridge then northwest around Glendale and Burbank and to San Fernando (which is part of Los Angeles itself), terminating at I-5 in Sylmar (also part of Los Angeles. This portion of I-210 also happens to have the least amount of traffic for the entirety of the Foothill Freeway.

To say going west from Los Angeles on the 210 doesn't work at all, as the 210 doesn't even enter Los Angeles going west until San Fernando, at which point, it'll end very quickly and drop you into Santa Clarita and onto the Grapevine.

As for the Ventura Freeway (CA 134 and US 101), CA 134 spends a negligible 2.5 miles in Los Angeles between Pasadena and Glendale (negligible because the only two exits are for Colorado Blvd and for the Glendale Freeway... 2.5 miles apart), and doesn't reenter Los Angeles until its interchange with I-5 in Griffith Park.

Again, using the Pasadena Interchange as a basis for going west doesn't work, as it's northeast of downtown Los Angeles; it's east of Los Angeles' easternmost border.

A couple things to keep in mind here: I had, by the time I was four years old, the entirety of the Los Angeles freeway system memorized, by route name and number, and could draw accurate, if distorted, maps of the system.

Bick, I lived in that area of LA for three years and was in Pasadena a week ago. The 210 proper doesn't leave LA, no shit, but head west on the 210 without taking any exits and you'll end up on the 101. The 134 serves only to connect the two. I'm afraid my practical experience with these roads trumps your autistic map analysis. Sorry, bro.

This should be and probably will be challenged in court. A cop needs a warrant or a reasonable cause to believe that some life threatening situation is going on in someones home to enter it without being granted permission to enter.
If this is allowed to stand then they might as well scratch off the 4th amendment from the constitution.
