    Ok. While we don't typically take action for shit going on at other boards, we have a situation. Dayton's dual posing as a LEO at Trek has gotten us noticed by said LEA in question.

    I'm thinking it's time for Dayton to be disinvited from WordForge membership. Since Dayton has expressed interest in maintaining his Blue Room thread during his last ban, I'm willing to give him a deadline of Sunday to back up the thread. However, the ownership would like the feedback and opinions from everyone with Shelter access.

    It could still be a troll. Don't give up any data without due process.

    Like him or not, Dayton is one of our own and if he is genuinely in legal trouble we should stand by him. That doesn't mean approving of his behavior.

    He should be informed immediately of this development, and the situation should be thoroughly investigated.

    Really? Would you be saying the same thing if a poster, like say, Ted (he was the one who posted at the rape fantasy board, IIRC), was credibly accused of rape? We do know that Dayton claimed to be a US Fish and Wildlife Officer in that particular persona. I don't know if that's illegal since he didn't attempt to do anything like arrest someone for fishing without a license, for example.

    And here it gets a bit tricky. I don't see an issue with telling Dayton that someone claiming to be from the US Fish and Wildlife Service Professional Responsibility Unit was asking about him, but if this guy is genuine, we don't want to dick around. When you get to things like subpoenas and search warrants, then there's a need for lawyers, and things can get expensive. Mind you, I'd have no idea of what a valid subpoena looks like, maybe some of you here do. But given that Dayton hasn't made a secret of who he is and where he lives, I don't see the harm in telling the individual his full name and where he lives. It's not like someone poking around on the boards couldn't figure it out anyway.

    We're not planning to do that any time soon. Primarily because Dayton never ran that dual here, only at TBBS, which is where the FWS should focus its efforts IMHO.

    Plus, based on another email I received from the person that Bickendan didn't quote, they apparently know who Dayton is IRL and are, for whatever reason, just wanting to connect the RL Dayton Kitchens with the Dayton3 account (why they're wanting IP addresses and such).

    I'm no lawyer, but I'm not sure what "legal" trouble he could be in. I'm not sure how posing as someone from RL on a message board is illegal. :huh:

    This is where I have a problem. Dayton dragged his bullshit from another board here, pretty much bragging about it.

    That was all well and good and people got to laugh and make even more sport of the dumb motherfucker, but now that it may end up causing RL consequences (for @Ancalagon, mainly, since the board is technically in his name) I don't feel all that compelled to keep Dayton around any longer. It seems to me that Rule 8 would apply. :shrug:

    And I think it's likely legit. A .gov email address and the IP resolves back to the U.S. Fish and Wildlife Service HQ. :shrug:

    He didn't do anything here. Not seeing a cause for banning him, unless we're going to ban Tererun for admitting to illegal drug use (and lord knows what other things I've forgotten and that probably weren't true), the posters who have mentioned getting arrested for OWI, and so on.

    Since he's likely to be on the receiving end of a lawsuit from the slandered Fish and Wildlife Service officer soon, that will provide consequences aplenty.

    If authorities came here looking for information about those people we'd probably be having a similar conversation.

    The entertainment factor of that is why I'm not dead set in favor of banning him (though I lean strongly in that direction). :corn:

    Of course anyone who has serious reason to believe a crime has been committed should alert the authorities. But if somebody randomly emails asking for WF members' personal info, they should be told to fuck right off, law enforcement credentials or not. They can get a warrant.

    Who cares if it's Dayton? If you want to ban him, just ban him. :shrug:

    [Redacted] sent me a chat message this morning asking if Tuckerfan was the board owner. I said that he wasn't. [Redacted] replied and said that Tuckerfan had messaged him and told him Dayton's real name. [Redacted] also confirmed to me that they already know who Dayton is and are looking to establish a link between the real person and the Dayton3 account.

    He also asked if I'd heard back from the board "owner" and I told him I had not and that I thought maybe that person was "on vacation" right now.

    I asked if this inquiry was for a civil suit or something and he said they're looking at possible criminal charges for impersonating a federal officer.

    FWIW, I forgot to say that on Monday I searched LinkedIn and there really is a person with this name who works at USFWS.

    Sorry, this is bullshit. He never impersonated an officer here. What do they need any of our records for?

    And I seem to remember that the TBBS profile in question was supposedly an Oklahoma game warden, not a federal officer. :chris:

    They haven't been given any of those records and likely won't be until they subpoena them.

    Dayton admitted to using the guy’s name here. It was in one of Spot’s first threads, so they probably want it in case Dayton tries to deny it in court. And if Dayton edits the post, then they can add evidence tampering to the charges.

    As for how they found out about it, has anyone googled the guy to see if the stuff Dayton posted under that name shows up? They might have been doing a search on the guy as part of a routine check before giving him a promotion. Or somebody might have snitched, but I find it odd that they’d go after him, since he didn’t do it to do anything other than post on a message board.

    First and foremost, contact T'bonz if you haven't already and let her know what's going on. Second, as a fed myself, I take a pretty dim view of this sort of thing. But, technically, Dayton didn't do it here, so aside from referring it to Bonzie I see no need for other action on our part.

    Yeah, I mentioned that in post #9. :P

    He seems legit to me (though I don’t believe >REDACTED< is the guy Dayton impersonated; he’s an investigator) but as has been pointed out, all Dayton did at Wordforge was brag about running the dual. So I’m not inclined to help USFWS out at all. Let them subpoena if they have to.

    Anyway, here's the thread where Dayton admits to it. Note what he says in his OP
    (bolding mine)

    If Dayton's right about the guy, then we probably know why they turned up his postings here. If he's not right, well...

    Waiting for a subpoena is the right thing to do since Dayton could sue the board owners for violating his privacy without said subpoena. I would, however, suggest not making too big of a hassle for them if a subpoena does appear. Because that'll likely get more legal heat thrown on the owners, with demands to turn over the entire contents of the board.

    As for banning Dayton in response to this, I can see some merits to it. After all, he's brought unnecessary (and unwanted) legal attention to the boards. Not to mention that this would prevent him from editing his posts (and destroying evidence). But if you don't ban him, then there's a good chance we'll get to see an epic meltdown from him if this goes to court.

    Oh, and without making any references which could be easily traced back here, I have asked in a Facebook group I'm a member of, how we can track any legal proceedings on the matter. This group includes lawyers who've worked for firms hired by people connected to both the Trump administration and the Mueller investigation, so not exactly ambulance chasers. I didn't ask for anything which could be considered legal advice (I just said that an ex-member might be involved in a legal action and I'd like to be able to find out the details of this, even if it's not published in a newspaper), so they'll be more likely to respond. I'll report back with anything that I hear from them.

    Oh, come on, what you really mean is :fap: I mean, presumably, they'll seize his computers and search them for proof that he was the one posting, and said contents of the computers (ie any porn) will be entered into the public record. I don't think we need to speculate as to the kind of porn that might be. :brokeback: Then, there's also the chance that he'll throw his wife or daughter under the bus and demand that they take the rap for his actions (assuming this is a legitimate case).

    The first thing that jumps to my mind: Impersonating Officer or employee of the United States

    But, that's a tough sell. This is the Professional Responsibility Unit. They investigate claims against their agents. What this is likely, really, about is that they want to know if their guy was making bad comments online while using a picture of himself in their uniform. That's a termination offense for "Conduct unbecoming an officer or agent." They're just going to use the impersonation charge to try to scare the hell out of you and Dayton to get to the truth.

    I also can't see this randomly coming up. Someone likely reported it, perhaps from WF.

    The second step is to physically call Special Agent [Redacted] and verify that this is legit:

    The IP and email address are convincing, but we need to know.

    If this is legit, the third step is setup a single point of contact with board leadership. This also needs to be the person who calls to verify the legitimacy of the account. Give him any public information he asks for (links, etc.), but if he asks for anything non-public, politely decline and say that you'll need a writ, subpoena, or warrant

    The fourth step is to continue to point him to TrekBBS with references to e-mail addresses and direct links to T'Bonz's profile. Don't just tell him that the main admin is T'Bonz. Give him a link to her profile so he can easily contact her directly.

    Someone needs to contact T'Bonz at TrekBBS tonight. Like, now, to see if she's received anything.

    I contacted Bonz over at TBBS, and her exact words were: "Yeah, I heard from this guy once before. I also got an email today. I gave him what he needed."

    So Bonz is cooperating, and has acted on the information request. The admins are trying to get her into a group PM chat about the agent to get a full picture of what's going on.

    The replies I've gotten on my query, other than "comply with the subpoena," have suggested that when the subpoena shows up to check PACER, which is the Federal case locator (some related documents might be available for free, while others will require a modest fee), and the Arkansas section of Justia. Even without paying anything, you'll be able to figure out if it's a valid subpoena, as well as get a few details on the case.
