All case filings will be accessible via PACER. My own login has expired after several years of disuse, but it's easy enough to get one. It's all public record.

As to how the USFWS realized Dayton was impersonating one of their officers, it wouldn't have to have come from a tip. If you do a reverse Google image search on that photo, you get both the actual officer and Dayton's TrekBBS posts.

I missed this too and yeah. Whatever foolishness Dayton pulled at another board involving no one from ours isn't a reason to ban him. He's given us a whole host of reasons to toss his ass, however.

And assuming criminal action is taken....well, two birds with one stone

    An update.

I exchanged emails with the investigating agent last Friday:

    Email exchange:

    [Redacted]

I haven't heard any more since then.

@Elwood is this info we have to turn over or can’t he just subpoena GoDaddy? They got lawyers, I don’t so if they can squash this I’d prefer to let them try.

All you're going to do is add a hurdle. They're going to subpoena GoDaddy for your information. GoDaddy doesn't care about you at all, so they'll turn everything over as soon as it passes through their legal department. Then whomever pays the bill will, in turn, get another subpoena.

This still smells fishy to me and I wouldn't act until I'd actually talked to someone. Call it spidey sense.

Bull. Any investigator worth their salt would have asked what number you called and what time. He would have, should have recognized the hotline number and given you a direct line. His direct line should also be in his signature. He should WANT to talk to you on a recorded line.

Ending a sentence with a preposition in an official e-mail regarding a potential legal proceeding? The other grammar is atrocious.

Honestly, I may be wrong, but this just doesn't pass my sniff test. Talk. to. him.

I forgot to ask in my last post. What, exactly, are they requesting?

I'm not as tech savvy on the specifics of this as @Order2Chaos is, but some of that info GoDaddy isn't going to be able to provide, simply because they're not going to be paying attention to what's posted here.

Wow, serves me right for not checking this forum for a while.

    Thoughts:

I agree with Elwood that this seems weird.

If it’s legit: If the agent impersonated was, as Dayton said, allegedly a groper, the office may be trying to defend him against whatever Dayton claimed “he” did, or alternatively, to prosecute charges that Dayton muddied by his impersonation and they need to clarify.

Also possible: if this is USFWS IA, they may want to railroad this guy, and on finding potentially exculpatory evidence here, don’t want it to come to them in an admissible form, so they asked for something that they’ll need a subpoena for, and then don’t bother to get one. I hope it’s not that, but it would explain the weirdness. We should see if this case is in PACER.

    That said:

We should not cooperate more than the law requires. At the same time, we should consider limiting Dayton’s ability to edit posts to, say, 1 hour. If this office needs to prove the impersonated guy’s innocence, Dayton getting spooked and deleting his posts to date could result in an innocent man getting fired or going to jail.

As for what GoDaddy can turn over, uh, who’s the actual owner of the domain? Who renews it every year or two? That’s all GoDaddy can turn over.

As for what we can possibly turn over, all of Dayton’s posts are public, and we probably have a list of IP addresses. I *think* we can map them, but it’s a giant PITA. Easier to do it at the DB level, I think, but the output is not so nice. I don’t know (and can’t check right now) whether we have his registration IP anymore. Certainly not his original ones from previous incarnations of the board.

Penultimately: the TOS and privacy policy (do we even have one?) do not, AFAIK, prohibit us from cooperating with law enforcement at will. We should consider changing that, but for now, Dayton has no claim against us if we did choose to cooperate.

Lastly: when this is all over, we should consider banning him. We don’t need this kind of legal attention.

What's the procedure for that? I looked at the control panel for his account and don't see an option to adjust post editing.

There's no reason to refuse to provide contact information for whoever owns this place now, is there?

I agree that limiting his edit ability for the time being would be a good move.

FWIW, I just got off the phone with the Special Agent in Charge at the USFWS Professional Responsibility Unit (the phone number is on the FWS PRU page) and he confirmed that investigator [Redacted] works out of that office and he knew what I was referencing when I said that I was calling to confirm that it was a legitimate request and not someone trying to prank the board admins.

I created a "Ban from editing/Deleting posts" usergroup, but I'm not familiar too much with the testing process of that, so perhaps @Amaris can able to test it out. I set the limit to 60 minutes of editing ability, but I'd also advise placing the post in question where Dayton discusses his impersonation into the Wayback Machine as well just in case.

An update to say that there is no update.

I've received no further emails from the agent and as of today the last log-in for the account he created here was 3 July.

Probably not business that should be posted, for Dayton's sake and the sake of the guy looking him up.

I don't trust Dayton not to pull his petty asshole shit if he knew about someone looking into him.

Information about the guy looking him up would be redacted before any release.

He knows. Quest told him via PM.

I'm not inclined to release anything until the matter has played out one way or the other, BTW.

Dayton didn't run that dual here, but he sure as hell ran here to brag about it, which is why we're having this discussion in the first place. Due to the former I'm not in favor of voluntarily cooperating with the records request, but the latter shouldn't necessarily mean that Dayton deserves extra protection.

Saying something shouldn't be released because it might give Dayton more rope to hang himself with is a strange stance.
