    The nurse was obstructing justice by refusing to allow the cop access to the patient. It's the defense attorney's job to challenge the admissibility of illegally obtained evidence in court. It's not the nurse's job to play junior lawyer and physically block a cop's path. She had called hospital administration, her supervisor was on the phone and had been appraised of the situation. The hospital lawyers should have gotten on the phone to the district attorney's office and worked it out.

    And the person they wanted blood from was the victim. The police where chasing someone who crashed into the victims truck head-on. The person being chased died.

    So why the hell would you need an innocent persons blood?

    She also has a responsibility to ensure that no harm comes to the patient in her care. Allowing a most likely unqualified individual to stick a needle into someone would be a violation of her own legal requirements.

    The second paragraph below is not in the Washington Post article.

    Salt Lake Police Sgt. Brandon Shearer said Thursday that Chief Mike Brown has seen the video and called it "very alarming." Payne is still on active duty with the department, but Shearer said he has been suspended from the blood draw program and an active internal investigation is underway.

    Shearer also admitted that the department's blood-draw policy "hadn't been updated for a little bit" when the incident occurred. But since then, the policy has been changed and training is scheduled to make sure all officers are up to date on the policy, he said.

    The officer in question was a trained phlebotomist. That's why he was on that special response team. So yes, he was qualified. The patient was not at any risk of harm, and nurse Hot Lips was right there to supervise the entire process if she was really worried the cop didn't know how to draw blood.

    The patient wasn't in any danger, the police officer wasn't posing a threat. No, it's not the nurse's job to "defend" the patient, that's the patient's attorney's job. If the blood came back dirty for drugs/ETOH, the attorney can go to court and challenge the admissibility of the evidence.

    If the nurse thought a heinous transgression was about to occur, she could have gotten a doctor to come over and deal with the cops.

    You don't physically block a cop's path. She had no authority to stop the cop from drawing the blood. She did the right thing by calling her supervisor, and the supervisor should have called the hospital lawyers.

    Nurse got what she deserved.

    The article said the victim was a "truck driver." So do they mean he was a normal guy who prefers to drive a pickup truck or an actual "truck driver" practicing his trade? If he is a truck driver then if he was in an incident/accident on the job they need blood for insurance/employment/legal reasons. It doesn't matter who was at fault - you are injured on the job they will take blood to see if you are on drugs or drunk or whatever - it's standard practice. They do that in my company too - you walk out the door for your lunch break and a branch falls off a tree and hits you in the head and you have to see a doctor - you are tested. Anything illicit in your pee or blood and you are fired on the spot.

    Please let me know when you happen upon a cop who has pulled someone over. Before the cop writes the ticket, be sure to approach the cop and let him know that you're not going to allow him to write the ticket until you're satisfied that all applicable laws have been followed and the driver's constitutional rights have been safeguarded. If the cop refuses to comply, physically insert yourself between the cop and the driver's side door of the vehicle.

    The reason I want you to let me know when this has happened is that I'll be sure to check YouTube for video of the cop pepper spraying you until your eyes melt from their sockets, and then repeatedly tasing your ass. Just so you'll know, I'll have made myself a big bag of popcorn and will wash it down with a nice Diet Coke. :)
