    The judge found there was no "actual malice", which is required for a "public figure" to win a defamation suit against a news organization as was laid out in the seminal "Times v Sullivan" case. Basically, the Times said "we fucked up; as soon as we knew we fucked up we printed a retraction and we're deeply embarrassed." What's nteresting is that the judge ruled while the jury was deliberating, but he's going to let them finish deliberating before he tells them his ruling. He reasoned that Palin will appeal and knowing how the jury sees the case might be helpful to higher courts. Ok...whatever. What probably did her in was not being able to clearly show just how she was "damaged" by the story. It seems a very obvious line of attack for the Times' attorneys and I wonder how it was that she wasn't prepared for it. You would think her legal team would have worked overtime to prepare her for that.

    This is a poorly executed version of scientology's fair game exploit. The main problem with their plan is unlike the scientologists the right wing actually needs the media and their lies to persist. Scientology wanted the IRS to stop auditing them. Trying to make the media buckle under the threats of lawsuits chills places like Newsmax, OAN, and faux news long before the times.

    Also, this is the most press Palin has had in a while so she feels important again.

    Palin was sort of the beta version of trump where they worked out some of the issues with the product and then launched it on us. It is interesting what was cut in the final version.

    They realized it could look like orange sick and no one would care. they kept the babbling idiocy because it made the village idiots laugh. They made it meaner and took away any of the quaint by installing the florida man package. They decided it would be more relatable if it played golf rather than stood in front of a turkey killing machine. The family was made much more douchy.Giving it a lot more of other people's money seems to have actually increased it's popularity.

    I would have thought they would have scrapped trump unit 0 by this time now that they got that dummy plug thing operating within dangerous parameters. I am just waiting for the present version to realize he was modeled after a woman. That is probably why he has the little hands because budget cuts.

    Yes, I am having fun in my own head with this shit so STFU and scroll on.

    At least hypothetically, the jury shouldn't have gotten to the issue of damages. Since there was not actual malice under current case law, Palin doesn't have a claim period and the jury shouldn't even consider the issue of how much this editorial might have harmed her. We will see if SCOTUS decides to throw out precedent because conservatives want to punish the media.

    If somehow the jury did find actual malice, though, I don't know how Palin would have shown damage to her reputation. Even putting aside the swift correction, her rep is what it is. Indeed, the notion that she was the victim of the lamestream media probably enhanced her rep in many quarters and she probably raised funds based on it.

    P.S. for a while, I was getting a message when I tried coming to WF saying the site was not secure. What was up with that?

    Web host's security cert has expired. For a time, we could barely get onto the site at all. You can get around it now on most browsers but it will give the warning.

    If she gets a new trial, it's gonna cost her or whoever is footing her legal bills some serious money. The case is still bullshit and she has no more chance of winning at this level than it did anyway. :clyde:

    They weren't sequestered and deliberations we're over several days. Jurors are told not to read articles about the case.

    One of the legal podcasts I listen to had a high-powered lawyer on (former Federal prosecutor or some such) to discuss the case after the judge made his statement but before the jury came back with their decision. He said that what the judge did was kind of weird but even if the jury heard about it and based their decision on that, it really wouldn't do much to help Palin.

    He said that the most it would really do would be to enable Palin to make her case before an appeals court, rather than having the appeal turned down as soon as it was presented. The guy's argument was that because Palin's (in)famous, there's a very high bar in order to prove malice and harm. If you have some high-powered lawyers helping you (see Hulk Hogan's lawsuit against Gawker, where his lawyers were paid for by billionaire Peter Theil), you stand a chance of winning, but Palin clearly didn't have such lawyers.

    The real obstacle for Palin was the "actual malice" standard. The Times owned the mistake and quickly corrected it. Now if there was an email saying "Let's nail that bitch Palin" they might have had a chance. But since a big part of her appeal with her base is hatred of the press, that probably would have just increased her popularity with them.
