    Escalation continue apace

    In Congress, nearly three dozen Republicans — mostly a who’s who of exactly-who-you’d-think, from old-timers like Rep. Louie Gohmert to new members like Rep. Lauren Boebert — are taking aim at queer people by way of what is already being called “a federal ‘don’t say gay’ bill.”
    The bill would ban any entity — public or private — from using federal funds to hold a program or produce literature that includes “sexually-oriented material” available to children under the age of 10.
    While that, in and of itself, would be an incredible federal overreach, there are three elements of the bill that makes its overreach a clear attempt at oppression.
    The bill defines “sexually-oriented material,” in part, as “any topic involving gender identity, gender dysphoria, transgenderism, sexual orientation, or related subjects” — meaning that literally anything queer, not just sexual materials as the opening language suggests, would be banned under the bill.

    Second, the bill allows any parent who thinks they’ve found a violation of this ban to bring a private right of action — meaning any parent can bring a lawsuit to get an injunction.

    Finally, if parents are able to get two injunctions from a federal judge — and think about who some of the district judges are out there — against an entity within a five-year period for claims that the ban was violated, the entity — again, public or private — can be barred from getting any federal funds for three years.

    The legislation, H.R. 9197, won’t be considered in this Congress, but if Republicans retake the House in the midterm elections, the House Education and Labor Committee could hold hearings on the bill next year.
    This bill isn’t all — not by a long shot. Here are just a few of the other stories of LGBTQ people facing new or ongoing private or government, including judicial, attacks that I’ve seen already this week:
    In Arkansas, a two-week trial is underway over the state’s ban on gender-affirming care for transgender children. Chase Strangio, who you saw on the Jon Stewart panel in the episode of his show that discussed the law, is down in Arkansas, part of the ACLU team fighting the law.
    At Balls and Strikes, James LaRock details how Trump-appointed judges in Tennessee and Texas have issued rulings attempting to constrain the Equal Employment Opportunity Commission’s efforts to enforce the Civil Rights Act of 1964 in the aftermath of the Supreme Court’s 2020 decision in Bostock v. Clayton County. In that ruling, the court — in a 6-3 opinion by Justice Neil Gorsuch — held that the sex discrimination ban in Title VII of the law includes a ban on discrimination based on sexual orientation and gender identity. But, a bunch of Trump judges (and other Republican appointees) don’t like that. So, they’re ignoring it or, at best, sidestepping it. As LaRock explains, it’s not even actual enforcement at issue here — it’s just EEOC guidance documents. But, here we are.
    There are individual attacks as well. Parker Molloy highlighted this morning how conservative media and conservative lawmakers team up to make private individuals’ lives hell merely for existing as transgender people. Check out Parker’s thread for more on how an informational letter from a school about a pregnant teacher’s forthcoming leave quickly escalated to Sen. Ted Cruz attacking this transgender teacher — and the very real life-and-death dangers of this sort of targeting.

    No offense to the trans community, but what the fuck did we think was going to happen when we started sticking our heads out of that closet? We were in that closet because of the abuse. They were never just going to give up. Did black slavery die when the emancipation proclamation happened, or did the fight get worse? Did racism die with the civil rights movement, or is it still going on? Did women get equality when they could vote, work, and get credit cards?

    The one thing that has started to happen is when they escalate prejudice the pushback becomes stronger. They are not going to push people back into the closet, but they will push some into the hospital or a grave. Just a couple of years ago a black man was chased down and shot dead in the street for jogging while black. It is the 2020s and the father and son being convicted is not going to stop that shit from happening again tomorrow. George Floyd's killer cops are behind bars and it is happening again today. But black people are not going back to being slaves without killing motherfuckers.

    GLBT people are not going to hide like they once did. We are no longer some little unseen group without connections. You cannot take it away. How often has censorship worked when there was no global network of communication? They try to ban porn, and that did not work. They tried to ban explicit lyrics, and that did not work. They did satanic panic and that did not work. There is going to be more fighting, but they won't end us even with another fucking hitler.

    They killed MLK but they could not blow out the fire he helped nurture. They lit a fire when they thought they killed mathew shephard.

    They make threatening rhetoric and try to make scary laws. I was afraid of them when I was a kid, and then I came out and found out how worthless they really were, and how good life is being yourself. You cannot take that joy away because it is already experienced and it does not happen under the fascism of others. The freedom of black people is so much better than being a slave. Having opportunities to work and be your own person without a man is so much better that you are not ever going to get women to stop. It infects other countries. There are women being killed in Iran because they tasted freedom and would rather fight to the death than to lose it again, and they will die for that cause.

    So the fascists are coming for a fight. They better think twice about whether or not their lives are worth some oppression of others, or if they figure it is they better:

    I'm convinced they are chosen that way on purpose. It allows the power that be, mostly the mega wealthy, to control them much easier when it comes to decisions that benefit them, and they could give a fuck about it hurting anyone else. Between the actual pedos, the frauds, the cheats, it's a whose who of GOP leadership.     What's really scary about this constant string of anti-trans bills, book banning and demonizing librarians and all this other fascist shit....

    Very few people publicly object. When police violently kill an innocent man the streets are filled with rage - as they should be!!

    But for the most part there's very little reaction to this neofascist trend on the right, not many lost elections, not many at protests in the street or in the halls of legislatures, even the politicians on "our side" are relatively soft spoken in their correct condemnations. That is basically a PERFECT recipe for a society willing to tolerate a pogram. I'm not that worried that most people are anti-trans or anti-gay, I'm not at all sure that is true, but about a third among us are HARD CORE bigots willing to do whatever it takes and most of the rest can't be bothered to rise in defense. And that's not yet getting to the quislings.
    There are not enough of us to save ourselves without allies.

    As I found when the bigots at TWC came at me, how can your allies even stand for you when their employment and economic safety is so easily toppled. Really, I could not even ask my allies to stand up for me when it was obvious the zero tolerance for a hostile workplace did not apply to "faggots" as I was called. The reason it did not qualify was because even calling someone an asshole was a firaable offense because it created a hostile work environment, but faggot was ok because it was not mentioned in the law or precedent. So if anyone stood up for me, they too would be terminated, and those people had families I cared for to think of. Even it was just them, I did not want them to lose their job for me because it could mean financial ruin.

    The people like @Bailey at the organization defended the worst of the worst. The people who called me names were the worst in the office. It wasn't the regular people, it was the two worse, most written up, most hated assholes in the office. every one of the mealy mouthed moderates completely ignored the reputation of obvious assholes. I am mentioning Bailey because I now know who this person is. These sorts of people are hard to root out at times because they are moderates. But they are the reall problem because they are the ones who try to conform the wave to the path of least resistance which is against the easily run over minority.

    I probably used to be that way too. Because it was safer, and it did not effect me. Because you cannot take a stand when you need your job to live, and you are not guaranteed a replacement because you are willing and able to work.

    One of the reasons the right wants economic instability for the masses is because it makes it easier to keep being racist, sexist, GLBTphobic, and prejudiced in every way possible. I don't even try anymore for a job for someone else because I can survive without being a part of that.

    More than one state has a copycat bill except it explicitly covers K-12

    Indiana for one. The forced outing thing is buried in several otherwise different anti-trans bigot bills.
