Prosecution is an entirely different thing than impeachment. It is completely legal and constitutional to prosecute a person who no longer serves as president for crimes they committed while president. Nothing about being president allows you to break the law and avoid prosecution for those crimes. The process of impeachment and conviction is how you remove the president from power because they have immunity from criminal charges during their term that does not carry on after they are no longer in power.
