They didn't find racial gerrymandering unconstitutional. They found this process for doing it did not meet the rules under which it is allowed/required.

Read the decision. It's all in there, including how gerrymandering is also prescribed to create minority districts.

Like I said, the Congressional Black Caucus absolutely depends on drawing blacks into their own districts.

They upheld a lower court ruling that ruled it unconstitutional.

..but more to the point, why did the Republican North Carolina legislature draw the congressional lines the way they did? Was it to fight voter fraud?

Suppose I have a bag full of shit. Even though shit is a noun, I can call it a shit bag.

Likewise, when a political party is full of shit, you can call it the Democrat party. And the individual turds within the bag are thus Democrat voters.

But if you think the adjective "democratic" applies, then I suggest you go ask Bernie Sanders. Because it doesn't appear that the shit party is ever going to let that guy have the votes he would get in a democratic party.

No, it ruled this particular redistricting action unconstitutional. Not the same thing. I don't think there are any new precedents here, just a finding that this case clearly violated existing law.

No, the voter fraud argument is for the early voting bullshit -- try to keep up. Obviously Democrat affiliation was the driving criteria, with race used as a cheap and reliable method to identify Democrats. Partisanship isn't racism, though I can see the political value to declaring everything that goes against the Democrats as "racist". When you play identity politics, you end up with a party whose members can be identified by ridiculously irrelevant attributes.

How is early voting conducive to voter fraud?

Okay. So it wasn't a racial gerrymander at all. It was a partisan gerrymander by way of targeting race, making the whole racial part irrelevant?

No. It was a partisan gerrymander, illegally relying on race as a proxy for party. Because everyone knows that's only legal when Democrats do it.

Some can, some can't. Why don't you fall back on telling married people they don't know what marriage means? If you're going to fall on your sword, make it worthwhile.

So you agree that they were trying to illegally disenfranchise black voters in order to give more of an advantage to Republicans?

No, of course not. If those had been white Democrats it would have been perfectly legal. So what is it about being black that makes the same legal action "disenfranchising"? Nobody was being denied the vote. Nor was it an attempt to do so.

LOL. No, this is where you and I have a different understanding of the process. To the Republicans, they're just trying to pack all the Democrats they can into the fewest possible districts. To you nutjobs, they hate blacks. In fact, under the rejected Republican lines black voters got much closer to perfect black representation in uniformly sized districts. The losers were the Democrat party, who might never get a majority in other districts without the automatic votes of blacks. When you cut through all the crap, that is what happened. And apparently what Republicans hate blacks for most of all is for being Democrats. That's what racism looks like in the 21st century.

If targeting black voters to get them to the polls to vote is okay then why is targeting black voters to prevent them from voting wrong?

It is two sides of the same coin with the same results (influencing an election) as goals.

Republicans don't hate blacks. Republicans hate Democrats. And vice versa.

If black Americans voted heavily Republican like they did around the turn of the 20th century then the GOP would be climbing all over themselves to get black voters to the polls.

Nobody was trying to prevent blacks from voting. The NC GOP was trying to redraw more black communities into two existing minority districts to block Democrat candidates. Not because they hate blacks, but because the goal of all redistricting measures is to reduce or eliminate your opponent's districts.

It comes with the territory of identity politics that any political maneuver can be interpreted as racist, or homophobic, or anti-Islamic, etc. That doesn't make it so. It's just politics.

By race because it's an indicator of party, not because of racist sentiments.

And I'm sure that's not what you've been saying.

Is this clown actually arguing "All black people vote Democrat[ic]?" as if it's some genetic predisposition? How do these people manage to tie their shoes in the morning, much less bumble onto the Internet? :jayzus:

I never said it was because of racist sentiments. If blacks typically voted Republican I have no doubt whatsoever that Republicans would be for early voting, against voter IDs, and against racial gerrymandering, and Democrats would almost certainly be against all that. I'm just saying as the voting habits of Blacks happen to lean right now, it's the Republicans that are illegally trying to mitigate the Black vote. I'm not the one saying it's only one side that plays that game.
