    I'm not "losing sleep" over this, myself, but when you kill people who are no longer a threat to you, it's murder, and you go to prison. :shrug:

    Not a single person is arguing the legal aspects of this other than the posters who can't stop feeling sympathy for this woman who broke into a house and assaulted an elderly man.

    Don't worry, I think what the guy did was wrong on both a judicial and an ethical basis.

    Some of you guys seem to think it's a shame he'll end up in prison.

    I feel sympathy for anyone who is killed unnecessarily. I feel sympathy for the old man for being robbed and assaulted, too. It is, in fact, possible to do both!

    It is a shame, but maybe not for the reason you suppose I think so. It's a shame that he chose to respond inappropriately, and the results of his inappropriate choice are therefore also a shame.

    That is true. When looking at situations like this, we need to remember something I've said thousands of times. Everyone thinks they know and understand the law. Unfortunately, only a tiny percentage of people actually do understand the law.

    That said, this will go to trial, but I'd wager 50/50 that the guy walks. Why? Because I've seen it happen before. 30 year old meth head breaks into house of 80 year old man. 30 year old meth head assaults 80 year old man. 80 year old man retrieves gun. 30 year old meth head tries to beat a hasty retreat. 80 year old man shoots 30 year old meth head in the back and by random chance severs spinal column just as 30 year old meth head reaches the street (about 50-60 feet from front door).

    You'll simply have to trust me on the finer details, but this case was a clear cut example. The 80 year old man was arrested for Murder and tried. The jury voted 12-0 to acquit because the Defense Attorney did his job and painted the murderer as a frail grandfather figure that feared his attacker would return at a later date.

    My initial reaction as well. However upon hearing further reports he may very well not be charged with a crime. Apparently this is the 3rd of 4th time in recent history where people have broken into his place and beaten him. Other neighbors have also been victimized. It is also reported that it was these individuals each and every time. So if that holds true, then yeah he probably won't get charged with anything because to his mind he was still under threat. That is what will legally matter, his state of mind, not mine or anyone else's. People forget that California has had a "castle doctrine" and "stand your ground" law on the books for quite a while. As it stands now the accomplice has been charged with her death as a murder

    This goes right back to what Elwood said, there isn't a jury in the land that is going to convict an 80 year old man who has been the victim of multiple incidents of burglary and battery.

    Hmmm......I've had a couple of family members survive bullet wounds with no long term physical or psychological damage, so I'll take my chances
    with the bullets versus risk the statistically dire outcome of the shacking up.

    So the jury pretty much came to the conclusion I did on the current incident. Any criminal who physically assaults you has the ability and motivation to bring future deadly intent. It was a jury of his "peers" so maybe they were all 80 year old trigger happy types.
    But I'm guessing not because the prosecution and defense can weed out potential jurors who bring the crazy, senile, prejudice, or other such tendencies.
    Smart money says he walks since this couple had been robbing/terrorizing other people too. Pretty much nation-wide people are getting fed up with violent
    criminals running rampant and showing their ass and nothing being done about it.

    Ok, so now this changes a lot. When I first read about this, I did feel that shooting her in the back was wrong since she was running from him. But now, seeing that this wasn't the first time these two attacked him that changes what I feel. I could see myself feeling scared that they would come back again, and that the next time they would go beyond a beating. So yeah, I can see and do side with him now. At the end of the day the preggo got what she deserved, and hopefully her accomplice ends up being charged with murder because she died during the commission of a crime he was involved in.
