The first amendment doesn't "condone" anything. However, if they try to claim burning a Koran is illegal, they will be running afoul of the establishment clause since burning a Bible is protected free speech.
If you actually bother to watch the video, it's abundantly clear that Breyer said no such thing and that Stephanopoulos is a liar trying to drum up interest in a story.

Inspired by Pastor Jones, I am currently in the process of scheduling a book burning of any paperback or hardcover with Fabio on the cover.
