Oh, this is rich. They say they don't want their names published because it will end up hurting the children, but the kids are going to end up hurt anyway by this piece of work bio mom. It has nothing to do with them being lesbians; it could have happened to a hetero couple, but this landmark case happens to involve a lesbian couple who went through several IVF cycles to conceive a child. australian couple sues doctor in landmark case This couple has a combined income of $120,000 a year. Apparently there was some miscommunication and two embryos were implanted by mistake. The doctor is quoted in a companion article as saying he doesn't have a legal duty of care to prevent multiple births. Anyway, the couple ended up with twins while the birth mother had been adamant about only wanting one child. They want a financial settlement to cover the cost of raising the extra child. The birth mother considered selective termination but was told it could cause her to lose both embryos. The birth mother has sunk into a depression. ... Sobbing, the woman described her partner as "a generous and loving person" prior to the 2003 procedure. "I find now that she doesn't have the same ability to love that she used to and the same capacity to embrace difficulties or issues as a couple or a team," she told the ACT Supreme Court. .... Having a single child would not be expensive or problematic and they'd never have to worry or buy food again. They want a $400,000 pay out. They wanted children enough to go through IVF, but having twins is so traumatic for the birth mother that's she's "lost the ability to love" and to deal with the difficulties that arise in day to day life. Perhaps my barren reproductive system is making me trés bitchy about the issue, but for some reason I find myself very unsympathetic to this couple's problem. Wrongful life lawsuit. Christ. What would the fallout be for the Australian medical industry if this couple prevails in court? Those newspaper clippings from back in '07 don't mean a thing, little Cindy Jr. Don't you worry. Mommy loves you. Suing the doctor because you're alive doesn't mean a thing, sweetheart.
Umm. Judge Tamar: "It is a known risk of IVF you are informed of before the procedure. You did it anyway. Discover the joys of adoption and have a nice day. Case Closed."
Oh, and tell me how money could ever compensate losing the ability to love. Not that I believe the bitch. Wrongful life...unbelievable.
Not to defend this ludicrousness (a couple that wants a child so badly should feel blessed to end up getting 2 instead of 1, IMO), but: I'd really like that part expanded on. What miscommunication could have possibly led the doctor to think the couple wants twins and not 1 child?
okay, 1.) lost the ability to love?! wtf?! how can you "loose the ability to love" seriously...unless you have ur heart broken multiple times...i can kinda understand that...but she just had TWINS for christs sake! and 2.)honestly...im against the whole genetically engineered birth thing..i dont like the idea. i say...just let nature take its course...you can try all you want....if you get pregnant...yea..okay...but..seriously...
Of course the senator suing God is trying to make an ironic point about bullshit lawsuits. Like this one. These women need to be bitch-slapped. Preferably by other lesbians and a few flaming queens, because they are setting back the cause of equal rights for homosexuals by this dumb-ass lawsuit.
Did this woman have any prenatal care at all? A sonogram would have shown there were two fetues while there was still time to get an abortion. She didn't. Why is that the doctor's fault? I feel bad for the children. At some point they're going to read about this case and realize they aren't getting as much as they should. After all, there is clearly only X amount of love in a mother's heart and they're foroced to share that amount of love. Poor kids.
Either that or one is the "real" kid, while the other is the imposter who the bad doctor man put in mummys tummy without her permission. I want a videocamera to watch birthdays and christmas mornings just to see them eyeing off each others presents trying to guess which of them is loved more.
If I was the judge, I'd get Biblical on their asses... drag both kids into the courtroom, grab a sword, and say "Okay, so which one don't ya want?"
The good thing about this is that lawsuits will soon become so frivolous and ridiculous (we're already there) that they'll fall into ill favor. Until then, I just laugh at the lament over costly health care. When doctors have to literally worry that a lawsuit might be lurking behind every procedure they do (or don't do), the risk associated with the job pretty much makes them deserve the big bucks.
Oh Your Honor! We want them both, even though we only have enough love for one. We just want more money.
According to the article, she was informed terminating ONE birth would likely lead to the death of the other foetus. So, she 'had' to keep both.
If this lawsuit were in the US, it would provide great fodder for discussion about frivolous lawsuits on the nightly news. Still, I feel terribly sorry for those children. There's no way they can't find out. How could they not? How many lesbian couples with twin girls conceived by IVF are there around? All it will take is one insensitive person to tell them, or one magazine article when they're a little older. One whispered, overheard conversation from the relatives. Kids are pretty good at hearing what we adults think they don't hear. They'll figure it out. There are plenty of couples in society who find out they're having twins, couples who probably don't have combined incomes of $120,000 a year. I'm sure they don't lose the ability to love. She wants a cash payment for the extra stress. What I still can't wrap my head around is how someone who wanted children bad enough to go through IVF, which isn't a picnic, can have so little love left over for a second....especially once they're born and you can see them and hold them. That doesn't smell right to me. It sounds like she wasn't that crazy about the idea of having a child in the first place but begrudgingly agreed. I hope the judge's decision is reported on--there's no precedent. I wouldn't want to be the judge. Eh, maybe they're just trying to squeeze the doctor and the clinic for money hoping they'll settle.
So, if you have conceptions problems, don't have children? A gay man should fuck a lesbian woman if she wants to be knocked up? With the many women in this thread who'd kill to be in this woman's shoes, you probably want to step away from this *now.* And hope you aren't even in the position to consider such a procedure in the future. Seriously. I saw a sixteen year old who hit the jackpot with TRIPLETS. No father in the picture, and it's obvious she wasn't even trying for one baby at her age, much less three. There are families out there who have multiple sets of children that struggle to make ends meet, and folks that love babies even when they didn't plan to have them. Fuck this bitchtard. And fuck the judge, if he rules in his bitch's favor. Perhaps. I wouldn't say that's much of an excuse. My aunt was pretty reluctant to have children after her first child at 21, and went through a tubal reversal to give my uncle two children of his own (oldest child had a different father). She loved all her kids until she died. And my uncle who wanted them soo badly hasn't raised them much in the eight years since she passed on. This sucks for those children.
