Monday, Judge Sarah C. Backus ruled all five adults charged with child abuse do not have to stay in jail until trial.

After an hours-long detention hearing, a judge set a $20,000 signature bond for each them, meaning they don't have to pay anything unless they violate their conditions of release.

Wahhaj, who is accused of kidnapping his son from Georgia in December, will be held because he's wanted out of Georgia.

This state has some serious issues keeping people in jail. One kid dead, 11 others found starving, living in conditions no human being should ever have to live in. New Mexico is really shitty like that, it's had problems for years being able to keep someone locked up until trial.

Some people do not understand how bail works according to this article. Bail is taken as a guarantee you will return to court. It is not the fine or punishment for the crime. If they violate the terms of their arrest their bail will be forfeit and a warrant issued for their arrest. This money is technically returned upon the end of the trial if they obey the terms of their release, but will be used towards their fines if guilty. This is not the fine they will get if found guilty as is suggested by the article.

I will say this does seem minimal considering their crimes, but new Mexico authorities will face massive public backlash if they don't return for trial and have to be recaptured. Maybe there are reasons to believe they will not run we are not aware of. The low amount does not make me happy, but people are entitled to bail while awaiting trial.

If they don't show up to court the same thing happens. They will have a warrant issues for their arrest and be chased down while they can also be convicted in absence. If you are worried about this sort of thing have the rich pay more in taxes and better fund incarceration facilities and the local government so they can house more inmates. This really is more of a funding issue most likely because the local processing jail is limited in size so they make choices to put people out on bail, home incarcerate, put people into rehab over prison, or even shorten sentences to free up bed space.

The reality is even with a conviction these guys will have options to get themselves out much earlier than a minimum sentence because they can count the prisoner as incarcerated while they are out on early release programs or shuffle them off on parole or probation which are funded differently but still receive taxpayer money for people on the roles.

This is the system that we have made. You need to spend money to incarcerate and hold people, and our elected officials get the first bite before it goes for holding prisoners. Tax the rich or stop your bitching.

my county loves to fine the dog-shit out of you. Most people in my county have way more money than they have time, and every day in jail means one less day on the job earning that money. So they pretty much get you "in the system" of fines/probation where you will be paying a shit-ton when you add everything up. It eases overcrowding but the jail still justifies its existence by booking & processing a sizable percentage of the total population - it's a brilliant business model!

Little bit of an update, 3 of the 5 accused are being set free because the Taos DA couldn't be assed to arrange a hearing.

Hours earlier, a judge dropped the 11 counts of child abuse they were facing, citing the prosecution's failure to hold a preliminary hearing within 10 days of their arrest, which is required by New Mexico law.

"They've made errors, that's clear," said Subhannah Wahhaj's defense attorney, Megan Mitsunaga.

Morten and Subhannah Wahhaj will have to stay in Taos County as part of their conditions of release for trespassing. Hujrah is free to leave the county.

According to those documents, Jany Leveille is described as the leader, actively recruiting individuals to the group and acting as the head of the group.

The criminal complaint states that Leveille wanted to marry Siraj Wahhaj in order to remain in the United States. They say she had a failed pregnancy a few years ago and claimed that Wahhaj's wife used "black magic" to steal her baby.

The complaint states that Leveille later claimed that she had received messages from God ordering Siraj Wahhaj to take Abdul, bring him to her and then leave for New Mexico where they would perform an exorcism on the child "to cast the demons from his body, after which he would come to life as Isa (an Islamic term for Jesus Christ)."

According to the documents, Leveille believed that "Isa" would then instruct them on what corrupt institutions they needed to get rid of, including schools, and military and financial institutions.

One of the children found at the compound told the FBI that Siraj Wahhaj had wanted to "get an army together" and train them for a "jihad."

That's a fair point. Obviously no one condones starving or abusing children, but homeschooling kids and teaching them about guns from an early age is supposed to be a good thing, so long as conservative Christians are doing it.

Tell that to the sandy hook kids.this idea that people with mental troubles step up and becomes a better person because you trained them to handle a deadly weapon is stupid. That is as dumb as pray the voices away. You don't give crazy and unstable a firearm and hope it becomes stable and reliable. That makes shooting we can prevent. Even if it is just a small part of our gun problem those are easy to save victims, or low hanging fruit. Violent crime may be a hard to handle issue with gun rights, but crazies with guns is something we can do better with quite easily.

I have to agree with you, nobody wants a mentally unstable person with a gun. The discussion needs to be one about improving and increasing our mental health services, though, and not one of banning firearms. Taking away guns isn't going to stop a schizophrenic person from hearing voices, if they believe killing someone is going to stop armageddon from happening, they will find a way to kill someone.
