Agree. If your life is worth defending why half ass it? I'm too old to get my ass kicked, but not to die. Thus, I would never get physical unless my intent was to kill someone or die trying. In other words if you are a threat, expect excessive force to be used.

Not at all. We have a Murder case going to trial on Monday. Man A and Man B decided to rob a gas station. Man A is the gunman and robber. Man B is the getaway driver that waits in the car. Store owner defends himself and his property and in the process, Man A is killed. Man B is charged with Murder.

It's actually Capital Murder, because Murder during the commission of any other Felony is one of the 18 qualifying criteria in the State of Alabama. But, for reasons unknown to me, the DA decided to go for life without parole in this instance.

My guess would be that the DA figures he can get a guilty plea on a life sentence and save a whole lot of time and money on a trial and appeals from a capital murder trial.

I don't know. When it comes to things like this, I'd rather not speculate.
