I don't think there should be a limit on any medical plans like that, it should be unlimited, otherwise it serves no purpose at all and these people end up with us paying the bills.

Absolutely! They suffered no injury, felt no pain, have no physical or mental limitations as a result of the accident, life goes on for them, but they get the most money. Rather than limiting torts, we should limit legal fees.

Actually, they lied to their "clients," conning them into believing they could actually recover money without using it to pay back for medical insurance coverage. That's either gross legal malpractice or fraud, and it's certainly not something that entitles them to any sort of fee.
So Wal*Mart did this. Big fucking deal. Hospitals do this all the damned time. It isnt like this is something new.
They should. Of course that recovery might also end up going right back to repay medical insurance or to the defendant originally sued. This is a case more appropriate for disciplinary proceedings considering the only thing that's really clear is that the lawyers took a fee even though they rendered no service. The injured party isn't their clients so much as a combination of the defendant they sued and the medical insurance company, who between them ended up paying more than the full medical costs because of the lawyers' fraud. This is exactly the kind of fraud by lawyers that's so hard to police because it's unclear who the injured party is, even though it's clear that the lawyers should be strung up by the balls.
If they can show the lawyers lied to them, then they should sue for fraud. In not, they're two kinds of stupid. *I almost didn't post this because it felt too prickish, but it's true.
CNN is behind the times. I'm pretty sure we discussed this case on WF a few months ago when it first came to light. Unless this is another, similar case.
Hate to be a cruel bastard here, but... 1. Need has no bearing on a legally executed contract. Read the fine print, let the buyer beware, etc. etc. 2. "Fair" ain't got nothin' to with it in this life. 3. Their son dying in Iraq has no bearing on this case at all. And let us not forget 4. I don't shop at Wal-Mart, nor do I encourage others to, and while they aren't the 'debil' people think they are, as a corporation they are pretty greedy, stupid, and now tied up in bureaucracy. They deserve all the bad PR they're gonna get from this, but anyone who would buy health insurance from fuckin' Wally World is dumber than dirt, in my book.
uhhhhhhhh she was an employee there. Of course she bought the insurance. It was the only type she could get short of buying hideously expensive personal insurance outside her job. Insurance who no doubt would have done the exact same thing Wal*Mart did.
Problem is, repayment clauses are in everyone's insurance. Why the fuck should YOUR insurance company have to pay for something that's the other guy's fault?

SHE WAS AN EMPLOYEE!! Why are you glossing over that point? Of course she is going to buy their insurance. I think the problem here is that it is Wal*Mart. It's been pointed out to you that she was an employee there and bought the insurance they offer employees. It's also been pointed out that no matter what insurance she had she still would have suffered the same since all insurance carriers have repayment clauses in their contracts. Yet you keep harping on Wal*Mart.
