No really, prohibition is *long* gone.... I saw part of a show of the history channel called "Hillbillies" and they showed a harmless old dude baned "Popcorn" (all my relatives from the deep south have weird-ass nicknames like that) and he had been arrested like 3 times for makin' shine. Why? This just seems like a totally waste of police time and taxpayer money. All over some homemade booze. When the legal, factory made stuff is all around us. Whom is protecting whom here, and from what?
I think it's a throwback to prohibition, but you may have a point as well...another justification. I mean here in the US (and locally it has been in the news) the law has tried to crack down on a a larege group of locals who trade in raw milk. Even arresting people...people who don't even buy and sell this milk, just belong to a kind of co-op for the stuff. And you can't legally bring certain kinds of cheeses (made with raw milk, of course) into this country, because the FDA gestapo has made it verboten. All seems kinda fucking stupid to me. My body, my choice, ya know.
I didn't think it was illegal anymore. I thought you only had to have a permit. The wikipedia says that during President Carters term, he signed legislation legalizing home brewing that led to the micro brewery craze.
Making booze at home doesn't allow the government, or "revanooers", to get their cut. While some unscrupulous brewers may use say a used radiator, my kinfolk never cut corners like that. I can say my people have had zero issue with sanitation or using questionable components and made some of the finest corn whisky in the Carolinas. I have a burn scar on my leg aquired as a little kid from goofing around stepping over the condensate line. Pop warned me it was hot, but I managed to get up against it anyway. "YIPE!!" "I told ya!"
Like Caboose said it's a taxation thing. The gummit doesn't think it can regulate it well enough to tax it, therefore it is illegal.
If you are only brewing it for your own consumption, then you are fine... It's the sale of moonshine which is still illegal.
