Unlike the bullshit the right wing imagines are violations of the constitution here is an actual case of a state violating the constitution. http://www.npr.org/sections/thetwo-...ign=npr&utm_term=nprnews&utm_content=20150723 Texas is refusing to provide birth certificates to hispanic women who cannot prove they are citizens. The problem is the constitution is absolutely clear; anyone born in the US is automatically a US citizen.
Not that I don't think this law, or what ever it is, is bullshit, but it's not saying the kids aren't citizens...just that their mothers can't have access to their birth certificates without proof that they are citizens.
That law also won't survive judicial review. California's proposition 187 tried to deny all public services to illegal aliens and the court threw it out as unconstitutional.
This is why A) citizenship should be granted by the states as it used to be and B) the fourteenth amendment needs to repealed and replaced because its interpretation has been abused worse than a woman visiting Bill Cosby's hotel room.
There's no functional difference between the state denying a child's citizenship and the state denying any legal method for that child's citizenship to be proven. A right without a remedy is no right at all.
Well, I'm glad all these voter identification acts will never disenfranchise any citizen, since everyone can easily prove their citizenship.
The birth certificate belongs to the child, a US citizen, and property of a US citizen should never be handed over to an illegal alien, especially identity documents that could be used for fraud and theft.
Awesome. When some state starts granting citizenship to people for the asking, where will your idea stand? That's even more stupid. Yes, let's eliminate this language from the Constitution: So Federal Farmboy wants 50 different citizenship rules, and also wants to give states the ability to deny citizens of their rights. When you think he couldn't be more stupid....
So Anc, would you care to elaborate on why closing a loophole that allows people to completely bypass the immigration process is "dumb" ? Or are you just one of those fucking morons who thinks we should just fling our borders open?
I didn't say I would get rid of this part: What I said was we need to repeal and replace the 14th amendment. If I were to replace it, I would write a new amendment with that language in it. To answer your other question, states can't just grant citizenship to people just for asking, there would be specific standards and once you are granted citizenship, you would be a citizen of the whole country, not just one state.
And I think we should raise the price on ammo 10,000 percent to keep whacks from shooting up schools. Lucky for you, we have laws on the books against sideways bans like what both of these are. ETA: I really don't think we should raise ammo prices to get around gun laws. I was making a point, lest someone like gtardo or his butt buddy Fleshlight brought it up in the future. :/
So you figure the states would get together to form some sort of compact, maybe call it Common Citizenship? Wait, aren't you the guy who hates Common Core because you think it's unconstitutional for states to get together to form some kind of compact?
