There was no audio on the video that I saw, so I can't really tell what's being said. Even so, it doesn't look like she was ever a threat, so I can't really see the justification for using a taser even if the officer felt that an arrest was appropriate.
Presuming the credibility of the driver's story, anything the cop did after establishing that she had no cell phone was completely unjustified. He tasered her and arrested her to cover up for his own mistake. That's assault with a deadly weapon and kidnapping, and it damn well should be treated as such if her story holds up. Nothing she did changes that.

A taser is not a deadly weapon. Also it would be battery (most likely aggravated battery) not assault if he got charged and it would be false arrest not kidnapping. Thank God your not a DA. No telling him many people would get not guilty thanks to you overcharging or putting wrong charges on them. As for the video it looks bad for the police but I'd like to hear the audio of what was being said and basically the whole news report turned into one big anti-taser piece. If it is true that she had no cell phone then the cop should have swallowed his pride and left. Unless of course he told her upfront she was getting a ticket for cell phone and speeding.
Rule #1 of dealing with a traffic cop: If he is boning you and you know he's got nothing, you get one shot to somewhat politely make your case. If that doesn't pan out, [quietly take the ticket and fight it in court]. Rule #2: The cop has all the power in the situation. You need to politely take the ticket and either fuck him with the judge or shoot him at a later date. Rule #3: If you've ignored rules 1 & 2 and then get out of your car and start to stomp back to the patrol car, expect a taser'in.
Which is Bullshit. In some states, it actually costs to fight it out in court. In Alabama for instance if you go to court, even if the case is thrown out you still owe $125 in 'court costs.' So unless you convince Officer Cartman to not give you the ticket, no mater what you are out a nice little bit of money.
They should change it so that if it does get thrown out the cop has to pay it out of his paycheck. I'd bet Alabama would see a lot more officers writing better tickets.

I don't see how the cop was in the wrong at least at the tasering point. The woman was approaching his car. He has no idea if she's armed, and no idea what she's intending to do. She's lucky she was only tasered. And as far as "looking like a threat" give me a fucking break -- you're armchair quarterbacking a situation based on a video that you're watching from the comfort of your own home. NONE of us are in a position to judge this situation. It could have just as easily have ended with the cop getting shot. I would have at minimum arrested her for disorderly conduct, and if she was stomping toward the squad car, she better hope that all I have at hand is a taser, because I will defend myself.

AFTER she'd stomped to the squad car. What if she'd been going for a gun? If people like you were running police departments, cops would be getting shot all the time. You have to give him the benefit of the doubt, not hamstring the cops with a bunch of arbirtary rules about exactly what has to happen before he's allowed self defense. I hope the cop receives some serious prison time for this. Not only did he falsify a crime, he attacked an innocent woman. This is precisely the thing that makes people have 0 respect for law men and reflects poorly upon them, but they will probably end up standing behind him. A bad cop is below a child molester in my book.
