    Im not in any way trying to defend this law or any of the stupidity surrounding this case.
    But to be fair you can be arrested for misinterpreting ANY law.

    Yes, and, although ignorance of the law is usually no excuse, if there was no harm and the person's intentions were good, there should be no prosecution.

    I can't imagine a prosecutor here deciding to put someone on trial for a similar offense. The prosecutor would be run out of town on a rail.

    The moral of the story is, if you find a gun laying around, you shouldn't think "My! This is dangerous! I'd better turn this in to the police right away!" You should go "Cool. Free gun!"

    Sounds like the interpretation of "possession" is the same as New Jersey's.

    Supposedly here, it's considered "illegal possession" if you go to the range with a freind and shoot each other's guns. You're illegally possessing his gun, he yours.

    Which is the real reason for zero tolerance where guns are concerned...hard to fight back without weapons.

    Gosh. England must feel so much safer now with this dangerous individual taken off the streets. Society is heaving big sigh of relief.

    The worst part is that odds are a crime was committed with that gun somewhere and this innocent man rots in jail for turning it in while the criminal runs free because he dumped it in this guy's garden. :jayzus:

    Friend of mine bought a new house, and while redecorating the basement, found a Walther PPK hidden in the suspended ceiling.

    She called the cops and handed it over. They thanked her, investigated the area where she found it (prints and such), and left her alone thereafter.

    Admittedly, I do not know how it works in the UK, but that would never happen here.

    It doesn't matter who the police arrest or why, if the District Attorney (Queen's Counsel) says no, it ends there. The police have no say in who is prosecuted or why they're prosecuted.

    Our DA would have either laughed at us or been pissed off for wasting his time if we tried to bring a case like that to him.

    Hmm... I am generally against the election of Judges (but never really put much thought in DAs), but I wonder how much the attitude you describe is due to the DA having to face an election?
