I think it's a strength. Causality often is more complex than X did Y. It's not that big a leap, or at least, it's fairly easily accomplished. Corporations, just like people, have accountability for their actions and the reasonably foreseeable consequences of their actions. It's reasonably foreseeable that people will get rowdy at a doorbuster sale and hurt other people. There are steps that the corporation can do to minimize that possibility, as discussed above (single-file lines, additional security, raffle tickets, etc.) By not taking those steps, the corporation is partially at fault.

I once did the Black Friday thing (at a Wal-Mart, no less) and yeah, it was brutal. It was stampede instinct all around, although it probably also didn't help that the employees were chanting "Go! Go! Go!" from the sidelines as well. (I felt like I was on that old TV gameshow Supermarket Sweep) My strategy was to get to the outer periphery of the herd and from there, carry out my greedy, consumerist plan.... and you know, it kinda worked -- was able to avoid the pushing and shoving for the most part. While I went and grabbed all the items we wanted, my sister stood by the register, more or less waiting in line so that when I arrived, check out would be quick as well. We were out of the store in about 15 minutes. I also decided that I would not be returning for Black Friday for a very long time, just wasn't worth it (as this article demostrates). There really should be a better to get more for your dollar than having to be corralled and then released like a pack of dogs.
Actually, yes. In the same manner that you have to assume there'll be drunk drivers on new Year's Eve, and riots after your team wins a championship, and all sort of other idiotic behavior on the part of supposedly rational adult human beings.
That's POSSIBLE...but we don't KNOW that this particular store practiced the proper crowd control methods. I'm not trying to say the crowd isn't responsible - it definitely is. But if you practice the manipulative bullshit that makes these crowds form, you have the responsibility to maintain order. Just like if you were having a concert or something it's your responsibility to have enough security on hand to keep the crowd in order. In any large event, the person or entity who sets up the crowd to exist is the person the law expects to see that order is maintained.

What Wal-Mart did was the rough equivalent of yelling 'Fire' in a crowded theatre - they knowingly created a situation in which people will act irrationally, and, here's the important part, didn't take the necessary precautions to mitigate said irrationality. There's the blood on their hands. And, well, I don't think anyone reasonable is denying the blood on the hands, or feet, of the stampede. However, no matter where the blame might or should fall, it would be in Wal-Mart's best interest to work out a solution to this problem, because someday, they're going to get a hell of a lawsuit out of it. This is exactly what Best Buy does and, surprise, while it's still a cesspool of shit masquerading as UA's 'responsible adults', nobody fucking dies there. Nobody fucking miscarries there. Because the ten people who are first in line get the shitty-ass laptop and then there's nothing 'worth' trampling over. Doesn't matter what you care about, every damn court in this country would find against you, and rightfully so. Like it or not, no man is an island unto himself, and that's the concept that I don't think you get. Hell, I know that's the concept you don't get, as it's pretty much every argument you've ever gotten into here. The actions of people affect people other than themselves beyond the direct interaction. You see the world as X -> Y, but what happens so frequently is V -> W -> X -> Y. Sometimes X is at fault for Y, but other times, X would have never occured had V not happened. It's not absolutely one or the other, and hell, sometimes it's both (hint: it was both with regards to the topic at hand). It's naïve to think otherwise.
If you see no difference between being deprived of free will "for your own good," and being punished for making irresponsible use of free will, you are just too damned stupid to live.

These are great examples. We all say people should control themselves. No one disagrees with that. However there are hundreds of thousands of examples throughout human history that show people in general act like idiots. Especially in crowds and especially when they are agitated or stressed. These are scientific facts. They've been studied by people ranging from behavioral scientists and police to the various military forces around the world.
Great example. Do we punish the bartender, the auto manufacturer, the company that paved the roads, or the drunken asshole behind the fucking wheel?
If the bartender knows you are intoxicated then yes he will be punished. These laws already exist on the books in many states and people have been prosecuted and sued.
With a fitting punishment after guilt is established, and only at the individual level. Again, what are they supposed to fucking do? Post SWAT teams in full riot gear and bullhorns? One day, everyone will recognize this non-argument for the empty rhetoric it truly is. I look forward to that day with great anticipation. But nobody is attempting a truly causal link. More like a failure of preemption, which is not the same fucking thing.

That's a shame. I've worked plenty of Black Fridays in retail. Wal-Mart, Sears, and Sears was the worst one. It was the year the PS2 had just come out, and I was the electronics associate, and in my hot little hand were vouchers for the 3 PS2s we had in stock (we had advertised 12, so this wasn't going to be pretty). People were already stampeding against the doors, and so my manager ran over, unlocked it and jumped back as people poured into the store, all heading my way, all grim and determined to get a PS2. I mean they were running and not slowing down at all. I wasn't going down over a game system, so I crumpled the vouchers up and tossed them into the air. They stopped and altogether watched it fly into the air, and landed near the front of the crowd. People started piling on one another to get to them, some people were punching, and all we could do was stand back and watch. There must have been a hundred people yelling at each other and fighting over the three vouchers. It was insane. J.
