Trump administration to detain migrant families and children for far longer with new rule

CBS News said:

Washington — The Trump administration on Wednesday unveiled a sweeping plan to detain migrant families and children for longer periods of time than currently allowed, touting a final regulation that would overhaul the immigration detention system in the U.S. and scrap a longstanding court settlement.

For more than two decades, the court settlement known as the Flores Agreement has governed the care of migrant children in U.S. custody. The 1997 agreement sets sweeping standards for the treatment of unaccompanied migrant children, from housing to medical care, as well as education, nutrition and hygiene. In more recent rulings, the federal judge overseeing the settlement has also effectively prohibited the government from detaining for more than 20 days families apprehended with children.

But the new Department of Homeland Security (DHS) regulation, a draft of which was published last year, would give immigration authorities more leeway in detaining families with children for longer, and modify the standards of care for unaccompanied children set forth by the 1997 settlement. The administration believes these changes would render the deal obsolete.

Under the administration's rule, which will be published in the Federal Register Friday and would go into effect 60 days later, there would not be a limit to the number of days families with children could be detained. But officials acknowledged that court challenges will likely delay the implementation of the regulation, which also needs to be approved by the federal judge overseeing the Flores litigation.

In a briefing Wednesday, Acting Homeland Security Secretary Kevin McAleenan said there is "no intent" to hold families for "a very long time," and vowed that the U.S. government would treat migrant children with "dignity, respect and special concern in concert with American values." He suggested that if cases involving detained families could be adjudicated at the same pace they were in 2015, they'd be in custody for an average of about 50 days.

Peter Schey, the lead attorney for the team representing thousands of unaccompanied migrant children in the Flores case, said the terms of the Flores Agreement prohibit the government from implementing rules that undermine it. In a Tuesday night interview with CBS News, Schey said the only way to terminate the settlement would be to issue a final regulation that codifies the full agreement into federal law.

Schey said he expects the judge that oversees the Flores case to reject the administration's efforts.

"These regulations do not implement the settlement. In fact, it abrogates the settlements. And so I think their efforts will be futile," said Schey, who had not yet seen the final regulations, but reviewed a draft published in September 2018.

He accused the White House of playing politics with children's well-being.

"They know that the only way the can terminate the settlement is by coming out with regulations that institutionalize it, but they have a history of criticizing the settlement," Schey said. "So what is this? I think it's a politicization of the treatment of children. It's part of running for reelection. That's what it's about."

Since President Trump took office in 2017, his administration has railed against the court agreement, saying it hampers its efforts to deal with large influxes of migrants like the recent months-long surge of Central American families and children journeying towards the U.S. Officials have maintained that migrant adults bring their children with them to the U.S. because they know immigration authorities cannot detain families with children for a prolonged period of time. Instead, families are typically released after days in detention and given a notice to appear in court.

According to a Homeland Security official, the administration hopes to eliminate what it sees as an "incentive" by detaining families until the end of their immigration proceedings. The regulation would not establish a cut off date for the detention of families with children, but the official maintained it would not lead to indefinite detention, as advocates fear.

The judge overseeing the Flores litigation, U.S. District Court Judge Dolly Gee, said in 2015 that the government needed to transfer children to "state-licensed facilities" within 20 days. But states operate facilities to house children, not families, which meant that the 20-day requirement became a time limit for the detention of families.

Through the new rule, the administration hopes to circumvent the 20-day detention limit by creating a federal licensing system to authorize facilities the government can use to detain families with children.

By making an end run around the Flores Agreement, the Trump Administration hopes to setup a new system where entire immigrant families would be detained indefinitely. Couple this with the recent announcement that children would not be receiving a flu vaccine while in custody, and adding the knowledge that illness is running rampant through these camps, there can be no question as to what we're seeing take full shape here. It must be stopped.

While the regulation does not specifically say Immigration and Customs Enforcement officials would also collect DNA from people in their custody, it also does not limit them from doing so.

In a statement to BuzzFeed News, a DHS official said the federal agency "is working closely with the Department of Justice on a path forward for DNA collection."

The official noted an ICE pilot program at the southwest border earlier this year, in which the agency took voluntary DNA tests of those they suspected of fraudulently claiming to be families. "ICE has identified dozens of cases in which children had no familial relation to the adults accompanying them. It's not even a matter of affordability. The Trump administration outright stated they didn't think toothbrushes, soap, et al should be included in care for these people:

Fabian said she thought it was fair to say “those things may be” part of the definition of safe and sanitary.

The government was in court to appeal a 2017 ruling finding that child migrants and their parents were detained in dirty, crowded, bitingly cold conditions inside U.S. Customs and Border Protection facilities along the southern border. Migrants are first taken to those facilities after they are apprehended at the border.

But although the conditions that were the subject of the 2017 ruling date to the Obama administration, the testy court exchange comes as the Trump administration confronts an unprecedented migrant surge that has overwhelmed facilities and caused serious health and safety risks within them. At least six child migrants have died since September, mostly after falling ill at detention facilities in the Rio Grande Valley. In this case, the Trump administration has continued to fight the 2017 ruling that sought to remedy deplorable conditions within these same facilities, at times blaming Congress for not providing enough resources to address the crisis.

U.S. District Judge Dolly Gee had found that migrants in Rio Grande Valley facilities were hungry, with some eating only “sandwiches of two pieces of dry bread and one slice of ham.” They were thirsty, with up to 20 migrants sharing the same cup to drink from the water cooler. They were embarrassed to use a toilet in front of 50 other people, and they couldn’t take a shower or brush their teeth or even wash their hands with soap and dry them with a towel, the judge found. At night, they couldn’t sleep. The lights were left on as they shivered beneath aluminum blankets on the concrete floor, the judge found.

Gee ruled in June 2017 that these Obama-era conditions violated a 1997 settlement agreement requiring that immigrant children in the government’s custody be housed in “safe and sanitary” conditions and that the government maintain “concern for the particular vulnerability of minors.”

But the Trump administration protested. The 1997 consent decree, known as the Flores Settlement Agreement, didn’t say anything about providing a “toothbrush,” “towels,” “dry clothing,” “soap” or even “sleep,” the administration has argued.

Therefore, the government now reasons, it shouldn’t be found in violation of the “safe and sanitary” requirement for not providing those necessities.

It is a direct result of Reagan slashing mental health care funding in the 1980s, causing the mentally ill to be put out in the streets because mental health clinics could no longer afford to take proper care of them. The same applies for the disabled who are homeless, many of them veterans.
