For anyone interested, though, this does not allow Sharia to supercede any British law. All it does is allow Muslims who seek arbitration in civil cases to choose to do so under Sharia and make the results of that civil arbitration legally binding unless doing so infringes legal rights under UK law. The exact same system is in place for Jewish Beth Din laws. In America it's Judge Judy, and frankly that woman scares me more than Paladin's cold-sweat "teh Mooslims are a comin'!!!" hysteria.

Do the parents of a child get to decide if their child is to be bound by the Sharia court? Or does the kid get to opt-out? Or are minors forbidden from being bound by the Sharia courts because it's too easy for them to be coerced into it?

But it's only "civil cases" - nothing to worry about.

Judge Judy and Beth Din laws ought to be gotten rid of as well. One system for everyone is the ONLY way to ensure fair treatment of all. Capitulation to any religious "judicial" system in any way, whether it be Sharia or Jew or Hare Krishna, is one of the dumbest fucking things I've ever heard of.

It's opt-in i would guess as it can not be above UK law.

So it can not use the hadith (punishment rules), just the civil stuff like voiding marriage contracts, dealing with inheritance and financial transactions.

The requirement probably stems from the notion that a woman should never be outside the company of her husband, father, or brothers.

The five witness rule isn't in anyway a disincentive to rape; it's a disincentive to the woman to ever be outside the control of a man in her family. It's like the ol' "she-was-wearing-a-skimpy-outfit-so-she-deserved-it" shtick only a thousand times stricter: "only-a-slut-would-ever-be-in-a-situation-where-she-could-be-raped."

Well, the inevitable happens.

The solution is simple. Don't sign a contract requiring a choice of law provision of Sharia law or requiring a binding arbitration agreement using Sharia law.
