Yes, the child is genetically male. A genetic defect that results in a male organism with female sex organs doesn't change that, any more than having extra fingers and toes would.

gender is physiological, not behavioural. folks who are actually transgendered are a brain in the wrong body, that makes sense. likewise, intersexed people make sense as a gender to me having qualities of both. their personalities are whatever they are, and surgery can add the defining touches, should those be desired, accordingly. none of these require additional third person singulars to an already over burdensome language.

In reality, you are in a position to demand exactly what you want, and your representatives will do everything they can to erase the identities of every trans person in this country, because they, too, cannot accept what isn't within the confines of their understanding. What you ask is that I abide by their inability to grasp basic humanity, so that they can legislate away the identities of people who have never harmed them.
