As an immigration lawyer I have mixed views on this. There are certainly those people who come from parts of the world where they do genuinely face a threat to their lives and it's understandable for some to risk breaking the law in order to seek asylum. However, it is a fact that the majority of asylum seekers to the West are econmic migrants only and that there are a lot more people who do not make asylum claims who still break the immigration laws of the countries they enter and then come to people like me expecting to have a right to stay. My view is that unless an entrant can prove that there is a serious risk to their life then there is absolutely no justifcation for breaking the immigration laws of the country they have entered. Accordingly, upon breaking the immigration laws without exceptional justification they should be denied any right to remain in a permanent basis and thereafter naturalise.

And life, and liberty, and the pursuit of happiness, and the "right" to not have crimes committed against them, and so on. But that's about it. And if they get caught and deprived of liberty while pursuing happiness in a direction that doesn't lead straight back to Mexico, well, that's on their own heads.

Yes, they have the right to survive in the U.S. -- long enough to be removed back to their country of legal residence. They do not have the right to reside in the U.S. illegally. Stop playing compound-context games.
I agree, however, there are a number of people who think that the Constitution doesn't apply to non-Americans. (Insert Kirk's "E Plebnista" speech from "The Omega Glory" here, if you want MY opinion on the matter) That said, every immigrant has the right to try to come here...THE RIGHT WAY.
