Obama himself spoke to Russia and Poland's presidents in 2008 before Obama took office. I don't think the issue is that Flynn simply talked to Russia. It's that he was acting as an agent of the US government...asking Putin not to retaliate against the sanctions and asking to delay a vote in the UN Security council.
On a serious note, I don't think that justice will ever 'get' Trump. I find it much more likely that he resigns after pardoning himself and his family.
Because it would be a political nightmare for future Presidents and the country if a sitting President could be charged with a crime at any time. Let the House impeach, let the Senate hold the trial and convict and remove, and than charge him once he's out of office.
Flynn was an agent of President Elect Trump's transition team. The incoming President. It's a stretch. Flynn better have something else on Trump or this is a waste of Mueller's time.
He was negotiating on behalf of the United States with a foreign government, and he wasn't an agent of the United States government.
Certainly it is possible. It was just be a very bad thing for the country. A trial of a sitting President? What happens if a jury convicts him but the House doesn't impeach him? He's still President. How are you going to make him serve his time? And that's assuming you could find an impartial jury or judge. It would be better for everyone if Mueller wisely handed off everything to the House. Like Starr did with Clinton.
It's not mentioned in this very long article, but this guy has connections to Flynn. I think he and Flynn worked together on the plot to kidnap the Turkish cleric and have him smuggled back to Turkey, but I could be wrong. Anyways, he's flipped for the prosecution in another case and is spilling the beans about a billion-dollar deal between Turkey and Iran.
Flynn was on Trumps transition team. Trump at that point in December when Flynn was talking to the Russians is the incoming President. The transition teams talk to foreign governments. Flynn is in essence an agent on behalf of the United States at that point. If Trump told Flynn to talk to the Russians after Trump was President-elect than there is no case here. Trump hasn't done anything outside of what any previous President-elect and their teams have done. "Trump told me to talk to the Russians." "Was this after he was President-Elect?" "Yes." There is no case at that point. All Trump and his lawyers will do is drag out Obama, Bush, Clinton, Bush, Reagan, Carter, Nixon, and all other Presidents actions while they were President-Elect. Flynn better have something else on Trump because this currently is a charge that won't stick. Like during the general election or even the primaries that Trump told Flynn to talk to the Russians and Flynn has proof of it. Than you'd have a case for impeachment at that point.
I would imagine both would proceed concurrently. Once Mueller charges Trump and/or his inner circle that the House would start impeachment proceedings. Keep in mind that criminal trials can take months to years to kick off.
