    It is highly irregular for a President to make such strong statements about a court's actions, almost as irregular as it was for him to assault the court in his state of the union address.

    I think that his assault on the court might be the nudge needed to get the overturning votes over the top.

    The man might be a great organizer, but the measure of a true leader is whether or not they can bring key people on board with them. Obama is doing the opposite, leaking support from his own party along the way - and never bringing people from across the aisle into his camp.

    Ruling on whether a law is Constitutional or not is not judicial activism, it's the job SCOTUS is charged with by the Constitution.

    If you define this as judicial activism, there is no role for SCOTUS at all in this country. Fortunately, the Founding Fathers had intelligence, unlike the current stuttering clusterfuck of a miserable failure who infests the WH.

    Actually, I must disagree with this on a couple of points.

    First, there is nothing at all in the Constitution that charges SCOTUS with constitutional review. It just sort of worked out that way, because SCOTUS is the highest judicial body and, when laws contradict, a court has to rule on the basis of the higher law. That led to the principle of a SCOTUS ruling invalidating laws. But it took a while for it to be seen that that was implied in the Constitution. It is not "the" job SCOTUS is charged with by the Constitution.

    Second, that can still be judicial activism. If the Supreme Court invalidates a law on constitutional grounds, on the basis of something that is clearly spelled out in the Constitution, that is fine. But if the Supreme Court comes up with a novel interpretation of the Constitution ("The choice not to sell something across state lines affects interstate commerce, so that gives Congress the right to regulate all financial transactions, including those that do not involve crossing state lines") and uses that to rule a law unconstitutional, they are clearly guilty of judicial activism.

    Saw that. Looks like a showdown. The White House either has to say "No, Obama was wrong" or face a serious challenge to the president from the judiciary about the concept of separation of powers.

    I wonder if Obama thought he was increasing the chances of his health-care law being upheld with that kind of speech? As naive as he is, with his bloated sense of self-importance, he probably did.

    I wonder what they'll do if SCOTUS kills it or kills a part of it. "Will Obama Enforce Their Decision?" Yes, yes, we know what his people said, the Courts have jurisprudence, bla bla bla, but this president... Seriously, I believe it's a very real possibility. Considering how out there Obama is, he could very well pull a sword and essentially say, "fuck your judicial review; I'm not enforcing this. America [my re-election] NEEDS it too badly."

    It would be a huge power steal from the Executive Branch from the Judiciary. More Bush II on parade...

    Judicial activism is the Court creating laws and "discovering" new rights and laws that didn't exist before.

    Judging the constitutionality of a law is NOT activism. It is the constitutionally mandated duty of the court. Regardless of how they decide, this is NOT judicial activism in this case.

    Thankfully, not all Canadians are as stupid as you.
