Her own mom misgenders her in the hospital. The school did do something, they sent a resource officer to investigate the incident and found that she started the fight and found that she didn't die from her injuries. The media jumped on this because they wanted to push a false narrative as they usually do and the local papers did thoroughly investigate the story.

It does not make killing another legal, but this does explain why no one was charged with the assault. It should be noted this was when there was no murder that the police did not charge anyone. This is common when there is a fight where both sides assaulted the other. It is not that there was not an assault at all, you lying goober. When there is a two way fight and no self defense the cops go to both sides and say they can press charges and both sides will face charges of assault they will probably be found guilty of because nothing gives you the right to throw water at or punch other people. When the situation was merely two people who went too far going at each other, it might have been the right move for both sides to avoid the courts, probation, and long term problems by just dropping it.

Problem is this became murder. There is no defense for killing another person because they got you wet. Maybe this is not intended murder, but it is a murder. Now the charges should come to the people who killed her that they are guilty of murder. This is also why the police did not initially charge the murder or the assault.

The idea charges do not apply for assault because someone else started it is stupid. That is a rule a teenager uses on their parents. You have the intellect of a teenager so adults will explain to you that it does not work that way unless you are defending yourself. No one dies from getting wet so if someone throws water at you it does not excuse your violent revenge. You go to the teacher or cops and press charges. Also, if you get your ass kicked for throwing water, you will have to face the consequences of assaulting another with water if you want the people who beat your ass charged also. However, if you end up dead because someone violently beats you to death for throwing water, the police do not have to worry about charging you with assault and can throw the other people in a cage for murder.

Nex had fatal amounts of benedryl and prozak in her system. Where I am sure the bullying would have contributed to the suicide, benedryl can kill you pretty quickly, and is easily obtained in fatal doses in the home. As for adding your bottle of prozak to that I am pretty sure that is going to help.

The person who assaulted her should now be charged with the assault as there is no reason not to press charges anymore, but this is not murder anymore.

Yes, but as for who started it, the other girl was insulting her. If you say that nex started the assault and justified it by throwing water, then the other one started it by needlessly insulting her. Starting it is the person who initiated the contact you idiot.

Evfen under your own description the proper course of action would have been to report the name calling or the water to the school authorities or the police. Nothing justified the later actions. If you expected nex to report the insult and not throw water, then you have to expect the other one to report the water and not bash her head into the floor.

It is not manslaughter if it is toxicity to a substance unless there is some evidence she was forced to ingest those substances. If she died from brain bleeds to physical results of the beating, then manslaughter or higher murer charges would be relevant. You cannot go weaponizing suicide against others. You chose suicide for you, not to get others punished because you are angry with them and cannot get at them otherwise.

I was wondering why they said it wasn't due to the assault, but it makes sense now that they found toxic levels of OTCs nex could have easily gotten a hold of without her parents knowing about. They should have released that info a little bit sooner, but I think the family jumped the gun and seems to have omitted the toxicity because they want murder charges against the girl. I cannot imagine the coroner telling them it was not due to the assault and not telling them their daughter pounded the pills they left her with when she was probably depressed and suicidal.

This does not mean there was not an assault, and the girls involved should face the consequences of jumping another student in the bathroom because they are going to do it again. There are schools for the violent kids where they all compete against each other.
