I thought the entire point of structuring the law that way was to make sure the state couldn't enforce it, and therefore to have a nice long period of women and doctors being intimidated before it ever got adjudicated.

From the legal opinions I saw tonight, if the Fifth steps in and overturns this it will be by far the most blatant "fuck you, we do Dominionism if we want" bullshit yet from an already fucked up court. The terms here apparently kind of paint the higher courts into the corner of actually having to hear it on the merits. I have no frame of referance as to whether that's irrational exuberance talking. OTOH, the law has a provision which, if you violate it's terms while the law is enjoined and the law eventually stands, you can still be sued later for your violation today so it's unclear how much the chilling effect will thaw. I still say the clearest path here is for McKenzie Scott or some other ultra-rich liberal (or team thereof) set up an escrow account to pay whatever fines are awarded and say 'sue away, bitches." Now, the bigger question is will the far right majority on the Supreme Court start invalidating marriage equality, birth control, and other rights once they have gutted Roe v. Wade. Essentially rolling the clock back to 1868, when the 14th was ratified, and giving the states free reign to legislate fundamental rights. It’s completely insane, but it works for the Alitos and Thomases of the world.
We can now see the writing on the wall for the purpose of these laws. It is the fundamental weakening of federal unity and power over the states to allow for the states to prepare for the divorce. Once you give the states these powers to deny rights and make themselves into different fundamental countries you will start seeing more of a populous migration towards states that fit their worldview because there is no federal protection for the individual in certain states. This will increase the problem of states becoming fundamentalist democracies. This was the thing the courts were meant to protect against. The courts were where a minority could argue their case for protections from democratic and representative tyranny. The courts are one of the places you can say the popular and representative government voted to harm me, but I have rights and you can step in the way. They are supposed to be our protection from the state and that is why the state is so burdened even in criminal cases to take away a person's rights. As we know if those courts are corrupt and politicized with racists and prejudiced people then they cannot operate as they are intended. This is what the right has always wanted. They want a christian religious theocracy in the courts. This is why it was so important to boot Moore out in AL when he was putting the ten commandments over the law. This is why our supreme court should never have had a person who is beholdent to their religion put on the bench. We should have some way to disbar and remove such a person from being a judge. You cannot be a judge when you admit to a religious bias. You could be a lawyer, but you cannot be the judge because you admit to not being fair. That should also go down the road for being of a specific party. How can you be a part of the political preference system and still be fair to the law? This is exactly what the right wants because it will factor into geographical areas of their dominance so that they can pretend they just want a simple divorce while they prepare for the war that comes after the lines are drawn and they are given their own resources.
