Judge Dismisses Ghislaine Maxwell’s Attempt to Use Bill Cosby’s Freedom to Shield Herself from Prosecution

Jailed former socialite and alleged Jeffrey Epstein enabler Ghislaine Maxwell on Friday lost a motion to dismiss a collection of federal criminal charges contained within a second superseding indictment filed against her on March 29.

The second superseding indictment followed a first superseding indictment filed in July 2020. The first superseding indictment followed an even earlier June 2020 initial indictment. It is not uncommon for federal prosecutors to ratchet up the number or the severity of charges a defendant may face as investigations unfold or as a tactic to attempt to secure a plea agreement.

The second superseding indictment added a sex trafficking count and sex trafficking conspiracy count to the charges Maxwell already faced. Maxwell unsuccessfully fought the additional charges contained within the first superseding indictment and on Friday learned she was unsuccessful at battling the two additional charges added in the second superseding indictment.

“For appeal preservation purposes or otherwise, the arguments largely, though not entirely, rehash the positions rejected by the Court in its April 16, 2021 Opinion & Order,” Judge Alison J. Nathan wrote. “To the extent new arguments are made, they are addressed below. All pending motions are DENIED.”

In other words, the arguments Maxwell lost the first time around did not miraculously result in a win the second time around when lodged in the same or a similar fashion — even as to the new charges.

For instance, Maxwell argued that four of the counts contained within the newest charging document are barred by Epstein’s own nonprosecution agreement in Florida. Judge Nathan ruled previously — and reaffirmed — that the Epstein nonprosecution agreement “does not bind the United States Attorney for the Southern District of New York.” The judge spent a few lines addressing this point yet again for clarity (citations omitted):

As the Court explained in its April 16, 2021 Opinion & Order, the Second Circuit held in United States v. Annabi that “[a] plea agreement binds only the office of the United States Attorney for the district in which the plea is entered unless it affirmatively appears that the agreement contemplates a broader restriction.” The Second Circuit’s opinion in Annabi is clear, and that court has followed it steadfastly since. The Second Circuit has held that language nearly identical to that in Epstein’s NPA is not enough to overcome the presumption in favor of single-district plea agreements. Adhering to this binding authority, this Court thus concluded (and continues to conclude) that the NPA does not bind the U.S. Attorney’s Office for the Southern District of New York. It thus provides Maxwell no defense in this case even if it would otherwise cover the conduct charged in the new counts in the [second] superseding indictment.

To bolster her claim that Epstein’s Florida NPA should be constructed as covering her own alleged conduct in New York, Maxwell pointed to the Pennsylvania Supreme Court’s recent rubbishing of Bill Cosby‘s criminal conviction. (Cosby’s legal situation has been widely parroted by Maxwell’s defense as an alleged “similar situation” to Maxwell’s case.) Judge Nathan disagreed and immediately noted that a Pennsylvania Supreme Court opinion is not binding on a federal district judge sitting in New York State. Plus, Cosby’s case involved issues arising within the same prosecutor’s office, not issue arising from disparate jurisdictions. As such, Judge Nathan continued to distinguish the cases as follows (and, again, legal citations are herein omitted):

[T]he state court in Cosby did not purport to decide the same federal question at issue here. In Cosby, the court held that it was unfair for a district attorney to proceed with charges against Bill Cosby after the district attorney’s office had, in that court’s view of the facts, unequivocally promised that it would not charge him. That case did not involve a question of whether one office’s promise bound another, much less whether a plea agreement in one federal district should be construed to apply in another district. Instead, the case focused on whether prosecutors were required to honor a promise that the court found to be clear in the absence of a formal plea agreement. Even if this Court agreed with the analysis in Cosby, that opinion sheds no light on the proper interpretation of the NPA in this case.

Elsewhere, Maxwell sought to have two of the counts lodged against her tossed because she claimed they constituted double jeopardy.

“The Court concludes that Maxwell has not previously been put in jeopardy for these offenses and therefore her prosecution on these counts does not violate the Double Jeopardy Clause,” the judge responded.

The court dismissed Maxwell’s other attempted arguments as follows:

Maxwell moves to dismiss counts five and six as untimely. The Court again concludes, as it did in its April 16, 2021 Opinion & Order, that the Government brought the charges within the applicable statute of limitations.

• Maxwell moves to dismiss count five and either count one or count three as multiplicitous. The Court again determines, as it did in its April 16, 2021 Opinion & Order, that this motion is premature and denies it without prejudice for renewal at trial.

• Maxwell moves to dismiss the S2 indictment for pre-indictment delay. The Court again concludes, as it did in its April 16, 2021 Opinion & Order, that Maxwell has not established that she suffered prejudice and therefore any delay has not violated her rights to due process.

• Maxwell moves for a bill of particulars related to counts five and six because they are too vague, and in particular do not provide specific dates. The Court again concludes, as it did in its April 16, 2021 Opinion & Order, that the charges are sufficiently specific.

• Maxwell moves to compel the Government to produce the statements of “Minor-Victim 4” in the S2 indictment as Brady material. The Court concludes that the current disclosure schedule gives Maxwell sufficient time to make effective use of any such statements and therefore immediate disclosure is not warranted.

Thus, the second superseding indictment stands, and Maxwell is scheduled to be tried in November.

Ghislaine Maxwell was present when Epstein abused me, accuser testifies

The first accuser in Ghislaine Maxwell’s child sex trafficking trial testified in Manhattan federal court on Tuesday that she was just 14 when the British socialite allegedly lured her into Jeffrey Epstein’s abusive orbit.

This accuser, who used the name “Jane” in court, alleged that Maxwell was sometimes present when this abuse occurred and participated on some occasions.

Epstein, a New York financier and convicted sex offender who counted Bill Clinton and Prince Andrew among his acquaintances, killed himself at a New York City jail in August 2019, while he was awaiting his own sex-trafficking trial. Maxwell, 59 and the daughter of the late British press baron Robert Maxwell, was arrested in New Hampshire in July 2020.

Maxwell is on trial for six counts related to her alleged involvement in Epstein’s sexual abuse of minor teenagers. She has pleaded not guilty.

“Did there come a time in your life when you had sexual contact with Jeffrey Epstein?” the prosecutor Alison Moe asked when Jane took the stand. The witness answered in the affirmative.

Moe asked her age at the time. “Fourteen years old,” she said.

“Did that happen once or more than once when you were 14 years old?” the prosecution asked. “More than once,” she replied.

The witness was asked: “Was there ever anyone else in the room?”

“Yes,” Jane said.

Moe then asked: “Who was most frequently in the room when you had sexual contact with Jeffrey Epstein when you were 14 years old?”

“Ghislaine Maxwell,” Jane said.

Moe also elicited testimony from Jane in an effort to establish that Maxwell groomed Epstein’s victims, by gaining their trust and gradually ratcheting up inappropriate behavior, to normalize abuse.

Jane told the court she had met Maxwell in summer 1994, when she attended a renowned youth arts camp in Michigan, Interlochen Center for the Arts. “We were eating ice cream,” recalled Jane. “We were sitting around socializing, and we see this tall, thin woman approach us.”

“She was walking a cute little Yorkie and the Yorkie came by us, and we asked if we could pet the dog,” Jane said. “We started chitchatting and petting the dog. The rest of my classmates had to go to class.”

A man, who turned out to be Epstein, came and joined Maxwell. Jane said they expressed interest in her time at camp, telling Jane that they gave kids scholarships; Jane had recently lost her father to leukemia, and her family had fallen into bankruptcy.

After they learned Jane was from Palm Beach, they asked for her mom’s phone number, she said. She gave them her mom’s contact information. When Jane returned from Interlochen, they called and invited her and her mother to tea, she said.

During tea at Epstein’s house, he told Jane’s mother that he wanted to see Jane sing. In the months following this tea, Jane started spending time with Epstein every week or two; Maxwell was usually present, she said.

They took her shopping and to the movies, “casual stuff”, Jane said. There were some somewhat odd things.

“I remember, maybe the first time I went to the poolside, and I walked out there and there was at least four women and Ghislaine, all topless and some of them were naked,” Jane said. “I was just shocked because I hadn’t seen that before.”

Jane said the first time Epstein had abused her was at his Palm Beach home, when he was telling her that she needed to focus on her desired career field in the arts.

“He said: I know everybody, I know all the agents, I know all the photographers, I know the owner of Victoria’s Secret, so I can make things happen, but you’ve just got to be ready for it,” Jane recalled. “The conversation sort of ended abruptly. It was in his office. He just kind of took my hand and said: ‘Follow me.’”

“He took me in the pool house and, on the right hand side was this couch, futon-looking thing, and he just proceeded to pull me over. He sat in the corner and didn’t say a word,” Jane said. Epstein pulled his pants down. “He pulled me on top of himself, and proceeded to masturbate on me …”

“I was frozen in fear. I’d never seen a penis before.”

Sexual encounters continued over the next three years during almost every visit with Epstein, about every two weeks, Jane said. When Jane was 14, 15, and 16, there were times when Maxwell was in the room during Epstein’s abuse; sometimes, she touched the girl’s breasts, she said.

“There were hands everywhere,” Jane said of one encounter with Epstein and Maxwell. Jane described being in group sexual encounters with Epstein, Maxwell, and others.

Jane repeatedly turned toward the jury as she spoke, and used hand gestures while speaking. She grabbed a tissue at one juncture, and kept it in her left hand for the majority of the later part of her testimony. At times, when she talked about sexual details, she would breath deeply.

Jane’s voice cracked at two points during her testimony. Jurors appeared to watch Jane’s testimony closely. Maxwell wrote several notes to her attorneys during Jane’s testimony, according to a pool report from inside the courtroom.

Jane was called to testify second, following testimony from Epstein’s longtime pilot, Lawrence Paul Visoski Jr. During Visoski’s testimony, he discussed Maxwell’s relationship with Epstein as he saw it, saying Maxwell was “No 2” in Epstein’s hierarchy, with Epstein “No 1”.

Later, Visoski said that this related to Maxwell’s handling of Epstein’s non-business affairs. She ran everything in Epstein’s life, such as managing his properties, that didn’t relate to his business.

Visoski was asked by lawyers for Maxwell if he had ever seen Epstein engage in sex acts. “No,” he said.

The question that really should be asked now is where did this huge snake go. These pewople did not just get cured of their depravity. They did not lose their money. One guy and his organization was shut down. This thing went somewhere else. It is like drugs. You make huge bust or you take down a crimelord and it does not stop.

But for the next decade we will have these disclosures to pretend we are doing something.

Well, I guess she can't anymore, being in jail and all. But whips in and of themselves are pretty low on my list of things to care about where she's concerned...

That may well be true, but the kink community already gets a bad rep as it is for just being kinky and implying this in and of itself is as bad as what she's been convicted of isnt a great thing for anyone to do.
