For goodness sakes she was thrown in jail and publicly humiliated. All for refusing to issue a license. Meanwhile we have an Attorney General who refuses to enforce this nations drug policies and cities like San Francisco who refuse to enforce our immigration laws. Least no one died with her stubbornness.

Plus if the voters want to punish her there's always the next election.

She was thrown in jail for openly defying the law and for not doing her job. She wasn't humiliated, she came out to Eye of the Tiger, with Mike Huckabee praising her actions, and a crowd of fans who were there to support her. Now she gets to go back to work, if you can call it that, and get paid to ignore the orders of the Supreme Court by discriminating against same sex couples following the law. Oh, that poor girl. Will no one think of her?

This case sets an interesting precedent. Would @T.R be singing the praises of clerks who refused to issue gun or drivers' licenses?

Well, without something new happening it looks like this is all over. She caved in and let her deputies issue licenses backed by the higher courts which means any challenge to their validity is going to be hammered because the courts have demanded they be issued and bumblefuck fattie town clerk does not trump a case decided all the way up to the supreme court. Of course, she might pitch a second fit if she gets sad her attentrion went away, but she seems well aware she will end up doing it from a cell. She is going to have to do something because the present situation is really not terribly interesting, and I think the sunday weekly wrap up is going to be the end for her if something new does not happen.

I do not think clerks of her position do the driver's license thing. I think the DMV clerks are a different department. Every time I have had to go to town hall regarding a license issue it has been to see the court clerk who is different than the town clerk. I would also be very very surprised if a court clerk defied the town magistrate.

However, there are other much more important duties of the town clerk's office than gun and marriage licenses. Not being able to buy a gun or get married may suck, but that office can make land purchases and business permits hard to get.

So -- whatever official is in charge of issuing gun licenses in a shall-issue state decides that he/she doesn't believe people should have guns. In addition to refusing to issue any permits, he/she also refuses to allow his/her staff to issue any permits (which was actually the real issue here -- if she had agreed at the outset to let her clerks do THEIR jobs and simply removed her name from the licenses, she never would have been held in contempt).

    What should be done?

here is the problem with that question. snagletooth heffer clerk woman was elected in KY before the laws changed. I will give her the reality that this was not a definite issue in KY when she took her oath. I think she is being given leeway by the courts because of that reality. At the time she took her oath handing out gay marriage licenses was not part of her job, and she actually took an oath in her head not to hand out the licenses. Yes, i know it was really to uphold the law of the land, and it should include changes, but this is really just an interim area. Despite her nasty attitude I am for giving her until the end of this term to use a work around. Next election will involve her taking a new oath to hand out gay marriage licenses, and if she cannot do that then she should be disqualified from taking office. Her issue has a solution right now, and it should just pass quietly until the next election, or untilt the legislature decides to impeach her which has no chance in the ass backwards state of KY.

A clerk who took an oath to uphold the laws of the state has taken a direct oath to issue gun licenses in a state which issues them. There is no room for leeway there as unlike lard ass they would have directly violated a part of the oath that was present when they took office. Now if some clerk in a gun free area finds themselves in a predicament where they had to hand out guns permits, I would hope they give that person a chance to give the deputies that responsibility, and of course the gun nuts would have meltdowns, and you would probably have to guard that person from terrorists like the oathbreakers.

Oh, and many town halls have multiple clerks to do these things anyway. To have one person covering all of these duties is a clusterfuck at best. Kim tried to funnel everything through her, but in reality that often is not possible for a single town or county clerk. Even those who approve gun licenses are often not doing it solo.

Here it is again if you are too lazy to click the link:

On immigration, federal law doesn't require that all people arrested be run through the ICE database. Only those who are arrested for a certain level of crimes have to be. Since it is not possible to codify every possible crime (considering every state is different) the law instead bases the requirement on sentence length. What 'sanctuary cities' have done is instruct their police to not run people through the database unless required to by federal law while at the same altered their legal codes so that crimes that would normally carry sentences say 'up to one year in jail' now go 'up to 364 days in jail' lowering the number of crimes that require running the names through the database.

    You're missing the point entirely.

Civil servants can't pick and choose what parts of their jobs they want to do. And if they have reservations about certain aspects, they need to apply elsewhere. I had a lot of reservations about the military, the way it's run and the mongoloid sea slug that pass for leadership within the Navy than hinder any kind of progress whatsoever, so I left the service.

If I pick and choose who I'm willing to sell cars to because I personally don't think they can or should be on the roadway, I'd be sacked. Why should this be any different for Kim Davis?

At least she won't be impeding on her underlings from doing theirs any longer. Given its Kentucky,I'll consider this a victory in itself.

I do agree, but the judges do not seem to be viewing it that way. I hate what she is doing, but she is out of the way at the moment. Personally I would not have given her this much time, but they are a dying breed. The more the internet invades the heartland and shines the light of the world on those hicks the less hold they have on our government. I am amazed it has come as far as it has, and when I see the kids of the parents around me growing up being exposed to gay and transgendered people in their lives they will understand that their tiny little town does not rule the world. The mark of the beast. It is the global network and it is going to take down what is modern religious bullshit. Perhaps that is not a bad thing?

The thing is, Kim Davis isn't a civil servant; she's an elected official. If she were a civil servant she'd have been fired a while ago, but impeachment proceedings against her hold little or no appeal to state legislators and are about as likely as Kim Davis having a stable, healthy marriage.

Alabama makes itself a joke yet again. The religious nutjobs are now attempting to stop the state recognizing any marriages if the courts make them grant equal rights to icky gays.

If her name is not on the license is it a true marriage license? I thought the court clerk had to sign for it to be a binding license.

Part of me thinks, especially because she kept talking about her deputies issuing "unauthorized" licenses, that she's setting up some future continuation of her temper tantrum in which she insists the licenses aren't valid.

If she wasn't doing her job she would still be ordering her staff not to issue them. She doesn't have to be physically present for that process to go forward. What difference does it make if it's her or her staff issuing them?

Geez, conservatives are usually so work obsessed, but when a bigot gets lazy, or a CEO goes on corporate welfare, or a trust fund brat becomes a party monster, the entire toolkit of excuses comes out.
