I'm sure they would argue the Dems weren't the government until the electors were recognized, so stopping that prevented Biden from becoming POTUS and so it wasn't an attempt to overthrow him, because Trump was still in charge.

No difference at all. There was not actual dispute or confusion about who won the election. It was not Trump. The Constitution specifies that a president’s term ends on January 20th unless they’ve been reelected. Trump was not reelected. Attempting to keep Trump in power after January 20th by any extralegal means at that point is unconstitutional. Trying to have an unconstitutional president is overthrowing the government. No different than if mobs had gone to the statehouses and forced, or tried to force, the electoral college to vote for Trump at gunpoint.

Why should they bother? It’s harder to prove the elements of the technical definition of the crime, and wouldn’t make a practical difference in sentencing, for most of them. Seditious conspiracy for the ringleaders is just as good.
