Anyone Looking Forward to Star Trek: Axanar?

    Exactly. This is why CBS has to be going after Axanar. They stepped beyond simple fundraising, and went into a for-profit venture. I guess they thought if Axanar was made for free at no-profit, they could make an end run around the issue, and if that is so, CBS will show them how that doesn't work.

    There was also a recent Facebook post by Alec Peters that said the new Ares Studios would be launching soon, and that there would be a kickstarter for it. Keep in mind the studio was already built with fan money that was to be put toward Axanar. The kickstarter is supposed to be for the launch. I can't find it now, but I'll keep looking.

    The part you're looking for, though I'm no lawyer, may fall under "unauthorized exploitation of Star Trek."

    Seriously, Cap, the people at Axanar don't have a legal leg to stand on. I say this as someone who was very much looking forward to the film. They did wrong here, and they have to pay up.

    Those websites were essentially free publicity. This is entirely different. The brand name is being used to earn money in this instance.


    An sufferably idiotic remark. Litigation costs tens of thousands of dollars. They aren't just going to do it out of spite - and if they were why not go after the others?

    Maybe because you have you fingers in your ears and are backing the wrong horse on this occasion. Peters is clearly exploiting Trek fans for financial and career gain and you're too caught up in a David vs Golitah fight to see it..

    Yeah, I didn't know about 90% of the fundraising methods used here. I figured a t-shirt here, a backstage pass to see the production there, but no, this looked almost like a licensed, endorsed production, which is no bueno for a fan film.

    I think the t-shirt, etc would've been fine had it been a crowd funding reward. The problem with the coffee is that in the process of raising funds it's also providing business to the coffee wholesaler, importer and manufacturer - business that it's relying on the Trek brand to generate. Add that to the studio building and the personal salaries of Peters & girlfriend and you have a clear and overt misuse of the brand name far beyond that of competing "fan" productions.

    Actual legalism and talk about intellectual property aside, no I do not care much for what the people that actually own the rights to Star Trek think. It was the people at Networks like NBC that killed the original series in the first place. It was Paramount that foisted Rick Berman, Brannon Braga, Michael Piller, and Jeri Taylor (along with Voyager and Enterprise) upon us. And of course the horrible Abramsverse.

    If "Star Trek" were all declared public domain (or whatever the term is) and we had half a dozen groups trying to make their own Star Trek I would not be the least bit upset.

    Actually, it was Roddenberry who foisted Berman on you and he the others you mention....and if it wasn't for Berman then the golden age of Star Trek that was the 1990s wouldn't have existed. He outstayed his welcome and should've gone years sooner, passing the keys to new showrunner/s. But Berman was the driving force behind the success of TNG, which ultimately is what gave us a 6th TOS movie, four more TNG movies, and four TV shows. Had Roddenberry been left to his own devices TNG would've died within a year or two and the franchise may well have been long forgotten about by now. He deserves a lot more credit than he gets.

    Well fortunately for CBS you don't have a say as to how or who uses IP that belongs to them. And IP cannot simply be declared public domain just so other people can create their own versions of it or to make a profit under it. If Axanar had been licensed by CBS or Paramount with profits going to them, then Axanar would not be facing this issue. But Peter's tried to or gave the appearance of something either shady or for personal gain. Of which the latter does not full under or is protected by fair use.

    Who would have thought that 'pointy ears' would be a legal term. I would think that 'pointed ears' would be a proper term to describe Vulcan ears.

    What's frustrating to me is that one of the people I wanted to see in action was Tony Todd, but as it turns out he quit the production months ago, even though Axanar was (and is) still promoting his character as a part of the Axanar film (that has yet to be filmed). They're still taking donations, too!

    On page 15 it says:

    4. That the Court find that the threat of irreparable harm to Plaintiffs as a result of Defendants’ conduct leaves Plaintiffs without adequate remedy at law, and therefore that Plaintiffs are entitled to an injunction restraining Defendants, their agents, servants, employees, attorneys, successors, assigns, subsidiaries, and all persons, firms, and corporations acting in concert with them, from directly or indirectly infringing the copyrights in the Star Trek Copyrighted Works, including but not limited to continuing to distribute, market, advertise, promote, produce, sell, or offer for sale the Axanar Works or any works derived or copied from the Star Trek Copyrighted Works, and from participating or assisting in any such activity whether or not it occurs in the United States.

    So anyone associated with Axanar might end up prohibited from the usual fandom type convention business.
