On the latest Jack podcast episode (it's a podcast dealing with Jack Smith's investigation into Trump) and ex-FBI Acting Director Andrew McCabe says that due to First Amendment reasons, there's no way that anyone can be charged for being part of a domestic terrorist organization. Foreign terrorist organizations are definitely a thing under the law.

I think that a carefully crafted law banning domestic terrorism organizations could pass SCOTUS scrutiny but that's neither here nor there. (After all, if you managed to enact such a law tomorrow, and get SCOTUS to sign off on it a day later, you still couldn't prosecute those pricks who did Jan 6th with it.) Given, however, that the Proud Boys were founded by Gavin "No Chin" McGinnes, and they, along with a shitload of other right-wing groups almost certainly have taken Russian money, I wonder if they couldn't be prosecuted as belonging to a foreign terrorist organization?
