    My point is that killing a cop is a capital offense but cops never pay that price even in cases like this one.

    In Alabama, killing a Peace Officer is only a capital offense if it's done during the course of performing their lawful duty, regardless of whether they are on or off the clock. I would imagine Texas would be in a similar boat.

    Well obviously the reason for that is to be a deterrent to people shooting cops. If you knew you'd get only a decade or two for shooting a cop you'd be more likely to do it in certain situations.

    And why should she pay a capital price for this? Clearly it's an accident. The prosecutor produced no evidence that it was a murder in the sense that she went to the apartment with the intent to kill him. Like I said a manslaughter charge and sentence is acceptable in this case.

    I didn't think that charge would stick as this seemed more tragic/negligent than malevolent, but so be it.

    Showing regret and contrition during the trial will no doubt help her at sentencing.

    Not sure it should have that big of an impact but it probably will.

    the judge is...….not bright. Thus here's what might happen if the judge continues on her tardwardly tangent: the trial gets so fucked up there's an acquittal or a mistrial.
    Justice will be served.....rare of course! Okay I stole that from shooter's meme.

    Seriously though I hope actual by-god fair and rational justice comes from this - it's no guarantee but you never know! Whenever a cop fucks up in my county they are publicly shamed and fired and incarcerated and so forth. None have shot a suspect (that I can remember) since I've been living here thank goodness but many cops have been physically attacked but that's par for the course. Old cops seem to get stuck working at the movie theater
    which must be :zzz: because the only action was when a couple was caught having sex during a movie.

    Actually, she cannot make an appeal based on the judge not allowing the castle doctrine. The jury considered it and was not advised against it.

    What a waste of two lives. Had there been no gun they would have probably both had a laugh at her being at the wrong door and life would have gone on. Instead the dead man's family and friends will forever know the loss, and her family and friends will also have to deal with her imprisonment over something so stupid.

    She doesn’t seem to be as dumb as some people claim. She correctly deduced that castle doctrine wouldn’t help an aggressor in someone else’s home, gave that to the defense, and the jury still convicted based upon the facts. How is that stupid? She likely just removed one avenue of appeals by the defense and correctly so.

    It sounds like maybe there is a reason she is a judge and maybe it is because she is kind of smart.
