ooops...... Based on your question I went back and reread the thread. Yeah Oldfella would be breaking the law. Volpone confused the issue.
I hadn't thought about that, but this guy doesn't know enough about them to know the difference (assuming he even looked at it closely). He doesn't know a dust cover from a dust bunny (he said today that the Mini-14 "clips" he saw at the show were outrageously priced).
Yeah Oldfella would be breaking the law. [YT="Breaking the law, breaking the law"]RATEoDH9WiY[/YT] BTW this razor blade would solve Tex's hair problems! Anyway, I myself call magazines clips, falling under the umbrella of "a shitload of pre-loaded rounds."
I guess the legal hitch is if the ultimate recipient gives the initial buyer the money. I mean, if a dad buys his young son a .22 with the intent of transferring it to the son when he's of age, that wouldn't be a straw purchase, would it? But if the someone gives you money to purchase a firearm that you intend to ultimately transfer to them, then that would be. I see no reason, though, why Oldfella can't buy himself an AR-15 and then decide a few months from now to sell it to his son. As long as the son doesn't give him money beforehand, how would that be a straw purchase?
We're really kind of debating "the gun ban loophole" here. One end of the spectrum would be some shady stranger in an alley with a stack of cash that asks you to go into the store and buy him a gun, which you then hand to him. The other end is if you were to, say, buy a gun and shoot it a bit and decide you didn't really like it. Meanwhile your hunting buddy happens to really like the gun so you sell it to him. Somewhere in between is oldfella's situation. I would argue that as long as he takes it out and shoots it a couple times, he'd probably be OK. In other news, the gun store that sold Mark Kelly his rifle has decided the guy lied on the form and isn't going to complete the sale. Still no word on if Obama's Justice Department will prosecute him as a straw purchaser. http://www.foxnews.com/politics/201...urchase-questions-his-intent/?test=latestnews
Legal, not legal, registered, unregistered, whatever. Of course before anyone in my family makes a purchase, we'll check it out legally to cover our asses and only for that reason. In principle all gun laws are totally FUBAR and nobody I know has any shred of respect for them, including myself. Sorry, we aren't Europe, and never will be.
