Implicit consent isn't consent unless it's spelled out in the TOS. It's not. So there isn't any. Get his explicit consent to use it, then use it. Otherwise, the image belongs to him. His property. Not yours. Not yours means you can't use it unless he gives you explicit consent for use. This isn't Facebook, and you're not two years old, so just because you saw it doesn't mean it belongs to you.

You are delusional. The incident and it's fallout was back in 2004. There was no coverup. If I was covering anything up why would I have volunteered the information that the picture got on the board by me and not by him? Not only that, I have not threatened to ban anyone at all, let alone try to ban someone for what happened in 2004. It is some bizarre point of view that somehow my doing that in 2004 means it's okay for you to do the same crime because it's really still my crime...that's plain crazy and frankly, nonsensical.
The avatar can be removed very easily. But it's down to Assvir to engineer it's removal since I do not recognise Tamar's moral authority or credibility on this issue. It all comes from trouble caused by her. There is a clear conflict of interest. She can remove it if she wants, or she can let Assvir sort the matter out. If she does the former, I can double standard bullshit.

Assvir and I have come to an agreement that has seen me remove the AV. I won't reveal the terms, but if he breaks it the deal's off. I still contend that he released the picture originally, but an agreement is an agreement.
Doesn't matter. This was always more about the everlasting abuse of Tamar's position and the fucked up application of the rules by the powers that be. It's time for freshness amongst the "staff".
Thank you for being nice. But to clarify one fact: The pictures I released were in the Green Room, back when it was also a protected place and no crosspost could be made to the Red Room. Whatever Tamar revealed was/is not the issue because she hasn't revealed/reused anything since back then in 2005. Also in 2005 is when I revealed a few pictures in the Green Room, not Red Room, which, again, was a protected haven back in the day. Just because the rules are 'different' now doesn't mean the pictures could be used by WAB or anyone else.
