    The Daily Caller I'll admit that I dismiss it out of hand. The reputation for Tucker Carlson's little love child is sketchy at best. As for the Tribune Article, it's nearly an editorial and he's wrong. The Tribune even contradicts itself in this article that I posted up-thread. The Police knew they didn't have implied consent.

    I'll take my own training that I went through and the SCOTUS ruling over your sources. Sorry. Time will show I'm right. :shrug:

    It is actually the result of a SCotUS case and is federal law. You are complaining the hospital didn't break federal law which is a really dumb position to take.

    Attacking the sources rather than the content. Time honored WF tradition. Also one of the reasons WF is no longer a place where genuine discussion of any issue can take place.

    Anyway, read the Utah statue. It's self-explanatory.

    And, regardless of the legality of what the cop was wanting, Hot Lips had no business trying to obstruct the cop while he was attempting to discharge his duty. If he failed to follow proper procedures, and if the results of the blood draw were going to be used against the (now deceased) MVA victim in a future proceeding, it's up to the guy's attorney to challenge the admissibility of the evidence on 4th amendment grounds.

    The article I posted is correct in pointing out that the outrage is a product of prevailing anti-police sentiment in the social media era. Not to mention it's a white, blond-haired woman getting handcuffed, so that ups the outrage ante.

Or you can place your faith in Elwood, the fake ex-LEO who thinks police departments should be subject to civilian oversight (the same civilians who hate cops because they're pissed they got pulled over and ticketed for going 95 in a 55 zone).     This applies "at the direction of a peace officer having grounds to believe that person to have been operating or in actual physical control of a motor vehicle while in violation of any provision under Subsections (1)(a)(i) through (iii)."

    The patient in question was the victim. There were no grounds to believe that person was in violation of any provision of the law.

    There are laws protecting patient privacy as well.

    Can someone please explain how Utah can pass a law which violates rulings of the SCotUS? Obviously it would be invalidated as soon as it gets challenged in court just like how southern states in the 60's kept passing new segregation bills the moment the old one got struck down. It's a dumb game, it doesn't pass legal muster, and the SCotUS ruling is very clear.

    Unsurprising. Police unions have been responsible for keeping even the most obvious examples of abuse from getting the officers to face any kind of consequences, and they've been responsible for getting laws passed against taking pictures and videos of police. Which goes to show you just how horrible unions can be. :D

    You are absolutely correct.
    If you're going to continue to counter Supreme Court decisions with cut-n-paste local statutes, then yes it is. I'm not a lawyer, I don't appreciate the, ahem, finer subtleties of trying to circumvent a higher court's decision until they're explained to me.
