New York Attorney General Letitia James has some questions about Donald Trump’s $175 million bond insurer—mainly, if it can even guarantee the full amount if push comes to shove.

In a court filing on Thursday, Knight Speciality Insurance Company revealed that its liquid assets don’t meet the needs of Trump’s already minimized bond. According to a financial assessment, the company, owned by billionaire Don Hankey, has just $138 million in “surplus.” Knight would therefore need to spend 127 percent of its reserves in order to cover Trump’s bond—far more than the 10 percent of a state-regulated suretor’s surplus that’s allowed by New York law.

Lawyers for the attorney general’s office also noted that the insurance company was trying to operate “without a certificate of qualification” in the state.

But that was, apparently, the plan all along, according to Knight’s president, Amit Shah.

“Knight Specialty Insurance Company is not a New York domestic insurer, and New York surplus lines insurance laws do not regulate the solvency of non-New York excess lines insurers,” Shah told CBS.

Shah also claimed that his company had more than $1 billion in equity, despite financial statements—which were only obtained after New York court clerks rejected the company’s original bond posting and ordered it to refile—indicating the firm only held $26 million in “cash and bank deposits,” with $483 million in stocks and bonds.

James’s office has given Trump and his new financial bedfellows 10 days to “justify the surety.”

“At this venture, with so much at stake, to make these kinds of mistakes, it’s almost unthinkable. And it amps it up with the missing financial statement. That adds all the drama,” an attorney for Michael Cohen, Trump’s former fixer, told The Daily Beast.

This is why I like her. Trump had to find a friend, and then say his friend had the money, and she is all like show me. She did not just believe it like other prosecutors would have, she wants to see it and make sure it is there because she is going to take that guys' money when Trump does not pay. If he does not haver the money to show then she is going to take Trump's shit and make sure the money is there.

Robert F. Kennedy Jr. said that he would appoint a special counsel to investigate whether Donald Trump’s supporters were subject to politically motivated prosecutions after Jan. 6, 2021.

In a statement Friday seeking to clarify his position on the Capitol attack, Kennedy questioned whether the riot qualified as an “insurrection”; echoed Trump’s claims that the prosecution of its participants was politically motivated; and said he was “disturbed by the weaponization of government” against the former president.

“Like many reasonable (sic) Americans, I am concerned about the possibility that political objectives motivated the vigor of the prosecution of the J6 defendants, their long sentences, and their harsh treatment,” the independent candidate said in the nearly 500-word statement. He wrote that the prosecutions fit “a disturbing pattern of the weaponization of government agencies.”

The special counsel would be “an individual respected by all sides,” he wrote, vowing to “right any wrongs that we discover.”

The pledge came a day after Kennedy sent out two fundraising emails claiming rioters who had been charged with crimes related to the breach of the Capitol were “activists sitting in a Washington DC jail cell stripped of their Constitutional liberties.” The emails compared them to Julian Assange, the founder of Wikileaks, and Edward Snowden, the source of the largest leak of NSA documents to journalists. Neither was involved in the Jan. 6 Capitol riot.

After media reports about his fundraising emails on Thursday, the campaign said that Kennedy did not write the emails himself, and the person who did has been fired.

“That statement was an error that does not reflect Mr. Kennedy’s views. It was inserted by a new marketing contractor and slipped through the normal approval process. The campaign has terminated its contract with this vendor. Anybody who violated the law on Jan. 6 should be subject to appropriate criminal and/or civil penalties,” campaign spokesperson Stefanie Spear said in a statement on Thursday about the fundraising email.

There is also a question of whether someone who is so incompetent that they don't bother to read what is being said in his name if they're competent to be president.

It would be appropriate if we were talking about plagiarism to bring up Biden's history of plagiarism. But he doesn't have a corresponding history of inflating financial numbers or figures, let alone have more than one settlement or verdict in the millions that he committed fraud. Found this in the torture thread that just got bumped. Seems relevant. Sarkozy has since done six months under house arrest though, not sure if that counts as bucking the trend.

I assume Elwood made this comment pre-Trump, and that it was in the context of seeing the inside of a jail cell for condoning torture at the hands of an international court. That's a different scenario from a head of state being found guilty of violating the state's own laws, which I'm guessing has happened more frequently, albeit still rare.

No one would have believed a president would have been involved in the level of criminality that Trump is accused of before it happened. And while the sentiment he expressed may still prove true for Trump or any future president, I would like to think that the principle that no one is above the law will win the day.

That said, there are various factors that may mean that Trump won't see the inside of a jail cell even assuming he's convicted in all the cases against him:

1. The sentencing judges likely will give him a lighter sentence than he would deserve, either explicitly or implicitly factoring in his age, his station, the effect on the country if Trump were literally behind bars.
2. Trump will appeal, and there's a good chance that the current Supreme Court with a 6 conservative justice majority and three Trump appointees will find some BS reason to either overturn his convictions or lessen his sentences
3, There is the possibility that Trump wins and self-pardons or even that Biden commutes any federal sentence, and the state governors do something similar.
4. Through the process of dragging things out, Trump may simply die before he has to serve any time.
