I think those of us who didn't spend last summer staring determinedly at a few busted windows saw enough police misconduct to not take a claim of resisting arrest at face value.

But my take on it is don't shoot a gun in an alley in the early morning hours then run from the cops while you are still armed, and the cops haven't ascertained why you recently fired your weapon. But hey, your mileage may vary. Regardless I'm done talking about it. I've voiced my opinion on the shooting to the best of my ability.

He was standing there, unarmed with his hands in the air when he was shot. Claiming he was armed when he was shot, was turning around when he was shot, or was in the process of raising his hands when he was shot are all bald faced lies.
No he didn't. He'd already dropped the gun before he even turned around. He stopped fleeing, dropped the gun, turned around, and had his empty hands raised, and then was shot.

That's after the cop shot. It happens really fast. He had just tossed the gun which the cop likely didn't see and proceeded to do exactly as he was trained to do, defend himself.

.8 seconds is a second. I've had gunfighting training. I'm confident that I would be able to hold fire 1 second after the threat had ended. Especially when no one was being aggressive toward me in the first place.
So in that training scenario, if a kid turned around unarmed with his hands up, and the trainee fired anyway, would said trainee have passed or failed? Because in all of my training, empty hands means "no shoot".
Famous last words! BTW the kid had just discharged a weapon - that's why the cops were there. But he took off with a weapon in his hand. He could have put up his hands right there when the cops showed up - he chose not to. And wouldn't you know it the kid was likely being recruited for (or already associated with) the Latin Kings gang. Yes, the gang that had been taking random shots at cop cars in the neighborhood. But it's all good! If you wanted to risk finishing your cop career in a body bag that would be your prerogative.
