    To clarify, falsifying business records is a misdemeanor, unless it’s in furtherance of another crime (felony or misdemeanor), in which case it’s automatically upgraded to a felony. Two different falsifications do not make a felony.

    As I understand it, Trump does not have to be convicted of, or even complete, the crime-in-furtherance. It’s up in the air whether the crime must be a state one or if it can be federal. Charges don’t seem to be public (already unsealed but not yet uploaded) but are likely 33 counts of falsifying business records and 1 count of something else, maybe conspiracy.

    Couple of notable things from the indictment.

    Trump made a payment to the Trump Tower doorman to keep a secret love child from coming out.

    Trump finalized his fraudulent scheme of payments in the Oval Office.

    Trump tried to delay payment to one of the women to after the election, because 'after the election we won't have to pay because it won't matter if it comes out.'

    If they can prove the last one that totally destroys the John Edwards defense, I did it to keep it secret from my wife.

    Not 100% how it works in NY, but the statute of limitations typically relates to when someone is charged, not when they're found innocent/guilty.

    We should recognize it does not seem to be against the law for a president or VP to take these documents home and put them in their hotel storage closet, or next to their corvette. As much as I would be fine with tossing both of them in jail for storage of classified documents in such a careless manner, we do not have standards that apply to presidents in this regard.

    Lying to the national archives about the possession, and showing these documents to others might be crimes. I am actually no longer sure as if it is a crime you have to be charged with it, and so far the fed seems to be unwilling to ever charge an ex-president with a crime. It would seem that there are criminal statutes which say this is a crime, but if you will never charge a president for not returning the documents you gave them, then is it really ever a crime?

    I think we need to seriously make some rules for presidents to restrict top secret and classified document storage, possession, and returning to be more secure than an 80's porn rental. Seriously, I was able to do worse to people who did not return their 5 dollar porn VHS to my dad's video store. A shot on shitteo copy of Debbie Does Dallas 5 is certainly not as important as nuclear secrets and I did more to get that back than the national archives. At least I knew who rented it and that it was overdue and not in a box next to their corvette. My dad worked as a top seller and teacher of checkpoint firewall. If he accidentally took one of his 128 bit checkpoint DVDs out of country to seminars he could have faced legal troubles because that level of encryption was limited to US distribution at the time. That was national security, and he was required to go through steps to get certified to have some of those materials. They certainly weren't in the pool closet or out in the garage next to his subaru.

    I do not want any president or ex president to be storing classified or top secret documents of this level in some unsecured box in their home storage, or to have possession of these documents for an indefinite period without the national archives demanding it's return with legal penalties.

    Yes, Trump did go the extra step of lying about possession of these documents, and hiding their presence from authorities. Those are things Biden did not do and they would seem to be a crime even though the DOJ won't prosecute.

    Something that all the pundits seem to be missing (despite many of them focusing on the weakness of the NY DA's case) is that the door has now been opened. If nothing else, a former president has been indicted on criminal charges. This is huge, whether or not Bragg succeeds in his prosecution.

    It means that all the long-held taboos about former presidents just went out the window. And I suspect the DOJ and special prosecutor are paying close attention.

    In other words, it's open season. :corn:

    Also, did anyone watch any of Trump's "speech"? It was more like the incoherent airing of grievances from Festivus than a speech.

    The man is certifiable. And he took shots at DA Bragg, Judge Merchan and Merchan's family. That's not going to end well for Mr. Trump.

    This was one incredible puzzle that he had to put together. 34 false statements on business records. The next thing to look for is the makeup of that jury: Who they are, where they come from and what their background is will make all the difference.
