    I wish it were possible for me to trust you enough to be a person of your word. If so, I would probably put an unreasonably large amount of money on the against the notion that the charges are ever just voluntarily dismissed by prosecutors.

    Or that it's Trump and his lawyers who are the ones who drag matters out.

    I don't think they will. As stupid of a defense as it is, the DOJ does not want to have to litigate "I declassified it with my mind," particularly if Trump remains out of custody on the inevitable appeal. The obstruction charges should put him away for the rest of his life.

    ETA: that said, depending on the specifics in the charges, it's possible they could bring mishandling classified info in if this fails for whatever reason. It wouldn't necessarily be double jeopardy depending on the timeline alleged in the charging document.

    Oh I don't know about that. It's almost certain that the charges will be dropped if a Republican wins the presidency in 2024, unless it's Liz Cheney, if this is still going on.

    No, that's the Republican model of how to deal with the email lady.

    But try to look at this from the prosecutors' point-of-view:
    You have an accused who is a former President of the United States.
    He has a lot of money. He may not be a billionaire, but he's got enough that he can, and will, hire some very expensive lawyers. He has divulged who knows what to whom, when it comes to classified material. He also has a rabid fan base that's shown a willingness to attack the Federal Fucking Government. You are going to have to proceed very carefully, and very cautiously, because no matter how well you can prove your case, there will always be some number of people who will claim he was innocent. You want that number of people to be as small as possible, because those will be the ones most likely to try and kill you.

    So, what do you do? You talk to the other prosecutors who are going after him and you say, "Look, we need to coordinate who files what when. Because we need to make sure that he can't say he lost the election because we always had him in court. And the first one of us out of the gate cannot miss." The other thing that you need to do, is make sure that he destroys himself in public. Off the top of my head, he's got cases against him in FL, NY, GA, and maybe NV, or pending ones. He's supposedly also going to be charged in DC at some point. If they dig up his ex-wife's grave and find documents there, they could charge him in NJ, too. There might be more charges coming in other places, I don't know.

    But I do know that even at the best of times he's a boorish monster. Now, imagine him being at a campaign stop, all jet-laggy and pissed off about how his trials are going. Sooner or later, he'll have his Senator Stillson moment, and that'll be it for the bulk of his fan base. That's when you start hitting him with the really serious charges. Might have a few straggling fans, might not. Equally important, that means he'll run out of money. That's when you go after the kids and the business partners. Maybe snag some Russians and Saudis while you're at it. Now, wouldn't that be tasty?

    I hadn't specifically contemplated that the criminal case from the documents taking till past January 2025. As slow as the criminal justice can be, I don't foresee that being the case unless Trump and his cronies drag things out a lot.

    But the bet would be against prosecutors voluntarily dismissing things, as opposed to being forced to dismiss them because of a change of administration.

    Or, and hear me out, the reason they chose the Espionage Act is because he violated it.
    The reason they chose the other charges might just be because they think that he violated them, including the intent elements of them.

    And as has been said a number of times, it seems fairly clear from what has been publicly known that Trump knew he had the documents, knew they were classified, and deliberately did not return them despite polite requests and a subpoena over a lengthy period of time. He even had his lawyers falsely claim that he had returned all such documents.

    Two of Trump's lawyers on the documents case quit 1 day after his indictment. Clearly they see a winner. LOL.

    John Rowley and Jim Trusty quit the case for reasons that were not immediately clear.

    "This morning we tendered our resignations as counsel to President Trump," the two lawyers said in a statement. "It has been an honor to have spent the last year defending him, and we know he will be vindicated."

    At least in the federal district court here, judges get cases assigned to them randomly. I assume that is the case for the Southern District of Florida.

    From what I'm seeing, there are a little more than a dozen district judges and like two dozen judges including senior judges. So like a 3-5 percent chance that it would be Judge Cannon randomly.
