It’s a fetus up until birth. Meaning it’s in a pre-birth developmental stage. It becomes alive when it draws breath.

Once there is a brain with neural activity it's a human. That's why 3rd trimester abortions are severely limited in almost all cases to only those fetuses that aren't viable, or if there is a threat to the health of the mother.
