It’s a fetus up until birth. Meaning it’s in a pre-birth developmental stage. It becomes alive when it draws breath.

That's why 3rd trimester abortions are severely limited in almost all cases to only those fetuses that aren't viable, or if there is a threat to the health of the mother.
