I absolutely reject the nonsensical position that producing porn of any sort is an exercise of "free expression" (except when that porn is making a philosophical or ideological point if such is possible). It's as stupid as the judges who said stripping was fre expression under the constitution.

That is not remotely what free speech and freedom of the press in the constitution was designed to protect.

There is no requirement that free speech be in any way constructive or appealing to anyone. Imposing such a standard defeats the entire purpose.

It was designed to protect unpopular expression from oppressive government and the tyrranical majority. This is a textbook case of exactly that, whether the specifics are compelling to you or not. If this guy isn't safe, then none of us are, period.

As I said earlier, some words and images convey IDEAS and viewpoints, some do not.

That is NOT to say that it should be open season on those which do not (I would take the contrary view) - simply to distinguish that which needs preservation for the survival of our form of government.

Which is to say, even if you take an obviously artistic and not pornographic image - David for instance - and ban it, people can still freely think and act in the direction of their government (like, for instance, giving the bum's rush to the ones who passed the ban if you choose)

On the other hand, if the government has the power to suppress IDEAS, then it has the power to crush opposition and maintain the incumbent's hold on power. This power is of a fundamentally different and far more dangerous nature than the power to deny us either titty pics or artistic nudes or any other form of entertainment.
