    I've been playing RDR2 again and there are hints that Bill is gay, but no-one says it outright.

    So I was confused, for a moment.

    The law also doesn’t apply to books with incidental references to LGBTQ+ characters or same-sex couples, “as they are not instruction on sexual orientation or gender identity any more than a math problem asking students to add bushels of apples is instruction on apple farming,” according to the settlement.​

    I look forward to the challenges of any book in which references to heterosexual couples are any more than "incidental."

    One of the problematic parts of the law from my perspective was that it allowed anyone to sue a school district and potentially be awarded large damages and attorney fees if successful. That in essence would incentivize as many BS lawsuits from parents about gay related things that they deem indoctrination. The threat of that would loom large enough that a savvy school administration would err on the side of caution.

    I am not sure how the settlement might address that component of the law.

    How is this even a victory if the law was not overturned or removed? How does sending out this memo actually do anything when the law is still there? Did the dems just give the fuck up because they are stupid? Oh desantis isn't in the news anymore so we don't have to fight his unconstitutional law? We will just leave it in place and I am sure the teachers won't bne scared at all because we sent out a memo saying we totally won't enforce anything in this law so go ahead and violate it.

    I am going to haver to go become a teacher aren't I? It is a good thing the duh is just hiring anyone now because they can't get any certified teachers to work under this crap.

    The fact the law exists is still overall a bad thing.

    However the previous strategy by DeSantis was to say "oh, we're not saying no-one is allowed to mention anything about gay people or hide the fact they are meant to be gay" while giving a giant supportive exaggerated wink to those people who would absolutely campaign to remove books and teachers and even students because of mentioning being gay in any way, and a threatening stare at their opponents. The law was vaguely written and broad enough to allow the effective outcome they wanted, without having to try and literally codify it into law.

    This case has ended with the court settlement going "cool, so since you state it isn't intended to prevent those things we'll make sure to publicly and officially confirm that right?" With DeSantis being forced to grin and pretend it's a victory because to do otherwise would be to acknowledge that they were trying to do more.

    Like I said, leave the law in place while they tell everyone it really doesn't work that way, even though at any moment a teacher could still be charged with it and then have to hire lawyers to protect themselves from the problem. Because teachers all have the money and time to risk having to go through that court shit because the memo was considered wrong by some Trump like repug.

    So really, the chilling effect of the law is still in place, and this means nothing because they did not overturn the unconstitutional law. They just gave the fuck up and declared victory.

    Yes, Desantis actually won if that is the case. That is exactly what he wanted to happen. He wants the law to sit there for as long as possible as a threat to any teacher that they could trigger this and have to hire a lawyer to defend themselves in court because no one followed through and got a decision that actually negated the law.
