    Warrant-less wiretapping on foreign phones? Legal. So legal that even Obama has not stopped doing them.

    Detaining prisoners caught on a foreign battlefield? Legal.

    So was slavery, and we changed the Constitution to get rid of it. We have not yet changed the Constitution to remove the requirement that the president be naturally born. It's the law.

    That being said, this is all giving me a chuckle. I don't think for a minute anyone, SCOTUS or otherwise, is going to overturn the Obama presidency. If the first black pres was booted 'on a technicality', imagine the civil unrest and rioting that would happen.

    Although it might be fun to watch on TV. :devil:

    Okay, first of all....there is a 99.9999% chance that Obama has all the legal papers he needs to be POTUS.

    But, secondly.....he should present them. He is the most important public figure in the United States, and there should be 'nothing' secretive about his life. I can't figure out why his original birth record wasn't presented to the Supreme Court, and made available to the public back 12 months ago when he first said he was running in the primaries.

    Yes. There was a dispute over his citizenship because he was born in the PCZ, so he quite rightly provided his birth certificate.

    I havn't seen them, but they have all BEEN MADE AVAILABLE TO THE PUBLIC. The problem with Obama is that he hasn't made the original available. It would have a lot of information, like the hospital he was born in and the doctor who delivered him. The electronic printout his campaign provided can be created by having a single living guardian provide information, and requires no first party doccumentation. Obama MUST have been born in the United States to be a natural-born citizen, because his mother wasn't old enough to qualify him on her own (she was only 18).

    His official, signed birth certificate would clear up ALL disputes the instant he provided it, and he is the ONLY President who has ever refused to produce a birth certificate when asked. Why doesn't this trouble you?

    We need more than this.

    Did you know that in New York you can no longer get a copy of the original, it's a computer print out only. I don't know if they keep them yet don't distribute them, but that's how it is here.

    Well, nobody is 'asking' to actually HAVE a copy of the original.

    All Obama has to do is give a copy of the original, along with a signed statement from Roberts that verifies that the original is genuine....to CNN and end all of this bullshit.

    Nope. I'm pretty sure (the state law website is down at the moment) that by statute the copy serves as valid evidence for all purposes for which the original might be used, and you're never getting the original by subpoena or otherwise.

    Regardless, in Hawaii and most states original birth certificate copies CAN be provided upon request of the named person or their legal guardians, so I don't really know why this is relevant to Obama refusing to provide a copy of his birth certificate.

    A court especially SCOTUS could compel the state to produce it.

    No law could ever prevent a court from demanding the state show it in order to use it in a case. The court could say a law like that is unconstitutional and just toss it to the side.

    Now you and I on the other hand might not get away with trying to compel the state to produce the original but a court order will get it.

    The same that was on the Obama campaign site...
    The "long" version can only be released with permission of the person, in this case Obama, him or herself...
    As factcheck, Jim Geraghty of National Review Online and others have stated the short version is the real thing and there is no reason to think his long-form birth certificate would have any different data...

    I guess Chief Justice Roberts should be hanged for treason then for allowing Obama to become president.

    Several reasons:
    - I'm not American
    - it is painfully obvious that Obama was born in Hawaii as the son of an American woman and completely qualified as "natural born citizen" to be president
    - it's fun to see that people are still going on about this, and like I said, you're not doing your side any good by pursuing this insane theory

    I don't find joking about the execution of the Chief Justice to be funny, but regardless it isn't his job to vet presidential candidates.


    Being born the son of an American woman who was only 18 and who hadn't been living continuously in the United States means that her involvement alone isn't enough to qualify him as a natural-born citizen. He MUST have been born in Hawaii for the qualification to be genuine.

    Who's persuing? I havn't signed any petitions, I'll just continue to point out it's damn odd that the first black US President, one who lived in Indonesia and has passports issued by foreign countries, who has a father AND a stepfather that were foreign nationals, has DECLINED to provide incontrovertible proof of his citizenship.

    I'll point it out to anyone who asks, and if he produces a verifiable birth certificate to the I'll stop, and so will everyone else. It's just odd he refuses to.

    Except Republicans really did stage fake riots to stop recounts in 2000, and they really did purge tens of thousands of eligible voters from voter rolls in Florida. Now, there wasn't any feasible remedy, so Bush was always going to end up President and the complaints would have been better directed at making future elections more fair, but the complaints about the 2000 election were largely legitimate complaints. There's nothing even vaguely legitimate about the birther nutters. They're not like the people who say the 2000 election was stolen; they're like the 9/11 truthers who say that George Bush was in on the plot with bin Laden.

    It's an electronic copy, if we're going to be pedantic.

    There is no reason whatsoever to think that the copy on file in Hawaii differs from the copy released by the Obama campaign. It's notarized and completely valid from a legal POV.

    Obama has done everything that a reasonable person would be expected to do. Marching to the tune of looneys who are trying to use this as wedge issue doesn't make much sense. Responding to such people only serves to legitimize their claims.

    If he did 'everything reasonable' how come when McCain's status as 'natural born' was contested the first thing he did was provide the actual, original signed doccument? Why is giving someone EXACTLY WHAT THEY ASK FOR unreasonable?
