And they would be correct. It doesn't take rocket science or a lawyer to see that those two should have been arrested for murder within days, not months.

    From today's Wapo:

The agency also is investigating the involvement of a third man, William Bryan, who recorded the video, according to Barnhill’s letter recusing himself from the case.
    ...
On Feb. 23, Gregory McMichael saw Arbery running through the neighborhood and suspected that he was responsible for a string of recent burglaries, according to a police report. A local news report found only one burglary in the neighborhood was reported to police between Jan. 1 and Feb. 23, involving a pistol taken from a pickup truck outside of Travis McMichael’s home.
    ...
He called for his son, Travis McMichael, and the pair hopped into a pickup truck and gave chase — the son armed with a rifle, the father carrying a .357 magnum. At some point they were joined by another man, Bryan, who helped corner the black man and later recorded the fateful video.

    Source

    And more from the NYTimes:

...in a twist emblematic of the small-town politics that have defined the case, that source turned out to be a criminal defense lawyer in town who had informally consulted with the suspects.

The lawyer, Alan Tucker, said in an interview on Friday that the video had come from the cellphone of a man who had filmed the episode and that he later gave the footage to the radio station. Mr. Tucker’s role was confirmed by Scott Ryfun, who oversees the station’s programming.

Asked why he had leaked the video, Mr. Tucker said he had wanted to dispel rumors that he said had fueled tension in the community. “It wasn’t two men with a Confederate flag in the back of a truck going down the road and shooting a jogger in the back,” Mr. Tucker said.

The articles posted above shed light on the history involving the victim with the suspects. The McMichaels were both involved with Arbery's brush with police 7 years ago when he took a gun to a basketball game. And then the car break-in outside the younger McMichael's house where a gun was stolen.

It's a south georgia cesspool and this was a premeditated lynching. I'm just sayin'.

edited to add: I'm just sayin': GUNZZZZZZZZZZZZZ!!!!!!!!!!!!!!!! gotta luv'em.

one source says Arbery was a convicted felon (they didn't list his priors) which is not relevant to this incident, but will be used by the defense to paint the victim in a bad light. Hopeful;ly the jury won't fall for that and stick to the relevant facts. BTW for those of you suggesting he could have carried a gun for self defense, not in this case because as a convicted felon he cannot legally carry a gun.

Arbery did carry a gun to a basketball game, which in Georgia is not that unusual.

Yeah, the asshole DA who called it open-and-shut (in favor of Billy-Bob and Trenton, not Arbery) pointed to Arbery's record and history of mental health issues. As if the two shotgun-clutchers could have actually known any of that when they chose to chase him down.

If Arbery having a record was known to the killers and this gets them any type of reduced punishment, that would set a scary precedent indeed! Here is why:
nobody should have the right to be cop/judge/jury/executioner over their neighbors. This being the USA a pretty big percentage of people have a criminal/arrest record of some level. Our jails & prisons are kept to full occupancy at all times. Do we need average citizens arming themselves to make a citizen's arrest of everyone with a record?

The 911 system and cell phones are a great tool - easier and safer than loading a shotgun! Let cops be cops and tragedies like these can be avoided - too easy!

there is some resemblance but then again we all know what bearing a resemblance to a bad guy can get you! :bergman: Seriously I can round up ten guys that look just like the guy marching - or the shooter - in about five minutes in any store parking lot in Georgia. But that would be seriously damning evidence if that was him in the picture!

"that he thought Arbery looked like a person suspected in a series of recent break-ins in the area."

one problem seems to have cropped up...

The two Georgia men who were caught on video shooting the unarmed jogger to death in February claim they were chasing a suspect behind a series of burglaries in the area. But a local police official said the last break-in the neighborhood was reported nearly two months before the shooting.

The last known burglary in the neighborhood happened on Jan. 1, more than seven weeks before the Feb. 23 incident that ended Arbery’s life at the age of 25, Glynn County Police Lt. Cheri Bashlor told CNN on Friday.

imagine that? the racist murderers lied!!!

Burglaries in the neighborhood? Might make the McMichaels' suspicions more understandable, but otherwise irrelevant. No burglary was in process, and if the McMichaels had solid belief Arbery had committed a crime, they should've referred it to the police.

Lots of neighborhoods have burglaries; that's no defense for using weapons to intimidate someone into submitting to an interrogation. If you have something solid, call the cops. And unless someone's threatening you or others, you should leave the guns out of it.

It's still unclear whether the McMichaels operated within the law. Not liking the law or thinking it unwise doesn't render it inoperative. They must be judged according to the law.

They've been charged with murder. Fine, if the evidence shows they've broken the law. On the other hand, if the charges are motivated solely by public outrage, it is an injustice to the men to charge them and the charges will not survive a fair trial.

Even if true it's not a crime.

And even if you want to stretch things it's simple trespass which won't fall under the citizens arrest law.

Generally in Georgia if you catch somebody in the act of committing a crime....on your property or a neighbor's property.. and kill the criminal it's not likely that you will be charged. In other words your innocence is assumed. That said it has to very obvious that the criminal could conceivably harm somebody. Running outside not close to a home or occupied vehicle? That doesn't cut it.

Yes the "citizen's arrest" is a thing here but not common. Most criminals would say "fuck you catch me if you can or try to detain me!" even if you are armed because they know you probably won't shoot them because you don't want to get into trouble.

That said the link Tererun posted about just how corrupt from the top down the town was means that most likely the shooters were emboldened and actually thought that they had the right to take the law into their own hands. Maybe when they said "stop! I want to talk to you!" that compliance was a given. That right there is some scary shit! I wouldn't want to live in a town like that. I've lived in tiny towns far from any metropolitan area but they weren't corrupt - that is the biggest factor here and I hope all of the cockroaches are exposed to the light of day.

hmmm.....well I guess we'll find out soon if Governor Kemp was serious or just blowing smoke when he said "I want those bastards behind bars today!" when the video was revealed to the public. Is this just lip service? Will he support the GBI when this turns out to involve a lot more important people and not just Cletus & Bubba?

So apparently there IS now security camera footage of Arbery entering a home that was under construction. It apparently happened IMMEDIATELY before his killing, while he was out for his jog.

Apparently he entered the house, looked around, then left without taking anything.

Does that in any way justify what happened next? No, I don't think it does. Not one bit.

So what if he did? Lots of people poke their heads into construction sites because they want to have a gander at how things are going or get an idea of what the place will look like when finished. I don't know about Georgia, but in some states the only way you can make a "citizens arrest" is you witness someone committing a felony. Trespassing doesn't fall into that category.
