If it's unconstitutional but necessary, then change the Constitution you stupid bitch. Laws don't mean anything if they are ignored by the legislature.

I swear, anytime any politician anywhere knowingly mentions passing an unconstitutional law, it should be an automatic death sentence for him or her. Drag that fucker out of city hall, the statehouse, or Capitol Hill and string that fucker up right then and there. There is ZERO excuse for any politician to knowingly mention ignoring the Constitution. If the Constitution is inadiquate, then change it.

And this ignores the whole "it's the law-abiding citizens that are the problem" aspect of this story.

    Fucking cunt.

Nothing unconstitutional about this at all.

Simply requiring that gun owners act in a responsible manner,
    like adults.

Of course, realizing that your firearm is stolen and calling the authorities immediately is common sense. However, I question the call for a law to do so.

Wiping your ass after a healthy shit is common sense. Should your government create a law that will fine and imprison you for not doing so... even if you would never violate such a law?

Is liberty so easily given away?

How can you disprove in a court of law that the straw purchaser didn't realize the firearm was stolen until it was used in a crime? :marathon:

Seems to go against the code to just say you have no idea where ya .45 is at.

No one has answered my question about why they don't simply set up sting operations for straw buyers rather than making a requirement like this.

Tonya Payne of the Pittsburgh City Council, and all the others who voted likewise, are guilty of treason against the United States, upon conviction of which a person shall be liable to suffer death, or imprisonment not more than five years.

And I know about 10 people off the top of my head who would say exactly that "who cares about it being unconstitutional" to a variety of things, as I'm sure the rest of you do too. We're living in this country's government's final hour.

It bothers me when a politician says the words "Who cares if it's unconstitutional". At the very least, I'd think you would be upset out of principle if nothing else.

Furthermore, this is an example of of applying legislation across the board when it's only aimed at a small segment of society. I dislike that. In the military, we called it mass punishment and it was a sign of bad leadership (not counting Basic Training). If they are concerned about this, then they should actively target the perpetrators. Convict those people of crimes and they will no longer be able to purchase guns for anyone.

There's the unwritten code, and there's the law. If you can't disprove that someone didn't realize the firearm was stolen, what's next? You make them keep it at the police station?

You think the bad guy buying the shit gives a fuck?

The point isn't about requiring gun owners to report missing firearms. The point is about an elected official knowing some piece of legislation is blatently unconstitutional and going ahead with implementing it anyways, and saying "fuck it, let the courts figure it out."

And that is bullshit regardless of what the issue is.

The Constitution is THE legal compact we have with government, whether it is at the Federal, state, county, or local level. Each constitution or charter is explicit in what that level of goverment can and cannot do and here you have an elected official, a majority of elected officials in this case, knowing what they are not allowed to make laws on and going ahead and doing it anyways.

In a just world, the citizens of Pittsburgh would drag each of the fuckers that voted for this out of their homes and string them up by their necks. And if they don't, the governeor should be willing to call up the militia or National Guard or State Police to bring theses vermin to him in chains.

If government isn't going to follow the law, why should I?

The Pennsylvania Constitution doesn't give the city of Pittsburgh the authority to make the law in the first place.

I'm not debating the necessity of the law. I'm saying the government of Pittsburgh MUST obey the law and that any politician that makes a law that they know is unconstitutional should be immediately removed from office, by force if necessary.

What about it? If I'm going to sell my gun under the table, all I have to do under that law is file a false police report and call it a day. Some criminal gets popped with it and I'm covered. Has the problem with criminals getting guns actually been fixed?

Throw criminals in prison for a long time if they us a gun in a crime and leave law abiding gunowners alone.

Except you don't have to do that.

A friend of mine had a beautiful Smith and Wesson Model 629. He wanted to sell it. I didn't want it and after checking my usual source, none of them wanted it.

A dealer isn't gonna give you shit for the gun, so you retail it yourself. My buddy ran an add in local trade paper. A guy called him, they met at a gas station in the middle of town, cash traded hands, and then the gun traded hands.

The only paperwork involved was a bill of sale. And, with that, my buddy is off the hook for anything that person may do with a gun. Only FFL holders are required by law to clear sales. Private persons are not.

Oh, and I just flipped through last week's edition of the Trade Paper. There are six pages of guns.

I'm right there with you, JCD.

It pisses me off as a lawyer, but as an American I'm outraged.

The same kind of contempt for basic decency and lawfulness shown by Bill Clinton when he wagged his finger at America and said he's not lying (as if it ever really was only about sex).
